XXXI. Provided always, and be it enacted, That whenever any fuch Accident by the burning or bursting of a Still fhall take place whereby any Diftiller fhall be prevented from the diftilling any Worts, Wash, or Pot Ale, within fuch Period of Six Days, fuch Diftiller fhall within Six Hours after fuch Accident, give Notice of fuch Accident to the Officer of Excife in charge of the Distillery of fuch Diftilier, and fhall within Twenty-four Hours next after fuch Accident give and tranfmit Notice thereof to the Surveyor of the Survey and Collector of Excise, of the District in which fuch Distillery is fituate, and to the Commiffioners of Inland Excife and Taxes, and in cafe of Negle or Failure in the giving or tranfmitting of fuch Notices as aforefaid, or any of them, fuch Diftiller fhall not be entitled to any Remiffion, Abatement or Reduction of Duty on account of fuch Accident, any Thing herein-before contained to the contrary notwithstanding.

XXXII. And be it enacted, That in all Trials on Informations which may be traverfed under this or the faid recited Acts, no Inhabitant of a Parish, Townland, Manor or Lordship fhall be deemed an incompetent Witnefs on account of his being, or being fuppofed to be interefted as an Inhabitant in the Event of fuch Trial.

An Act to amend the feveral Acts for fecuring the Collection of the Duties on Auctions in Ireland. [15th June 1809.]

HEREAS by an Act made in the laft Seffion of Parlia

ment, intituled, An Ad to amend an A& made in the Forty 48 G. 3. c. 63. feventh Year of His prefent Majefty's Reign, for securing the Collection § 6. of the Duties on Audions in Ireland; it is among other Things pro ⚫vided and enacted, That upon any Sale by Auction of any Eftate, Goods, or Effects, feized for the Benefit of any Creditor in Execu⚫tion of any Judgment by any Sheriff or Sheriffs, or Perfon employed by him or them, the Sheriff or Sheriffs, under whofe Authority fuch Sale fhall be made, fhail be liable to and fhall be charged and chargeable with the full Auction Duty on all Goods and Effects fold at fuch Sale, and that a Return or Account of fuch Sale, and Payment of the Duty thereon, fhall be made by or on the Part of such Sheriff: And whereas it is expedient that no Auction Duty fhould ⚫ be paid on fuch Sales;' Be it therefore enacted by the King's most Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Farliament affembled, and by the Authority of the fame, That after the Expira- Sale by Auction tion of Ten Days after the paffing of this Act, in cafe the Sheriff of Eftates or under whofe Authority any fuch Sale fhall be made, or his Under- Effects taken in Sheriff, fhall certify at the Foot of the Return or Account of such Sale, that all the Eftate, Goods, and Effects, in fuch Account fpesified, were really the Property of the Perfon against whom fuch the Sheriff, as Judgment was had and obtained, and that the fame and every Part required by thereof were actually feized in Execution of the fame Judgment, in 47 G. 3. ft. 1. Quarter Seffions in Ireland; and for amending an Act of the
Parliament of Ireland, made in the Thirty-fixth Year of His
present Majesty, relating thereto. [15th June 1809.}
great Inconvenience refults from the Uncertainty
and Difference in the feveral Counties of Ireland, as to the
Rates of Fees payable on Criminal Prosecutions, and the feveral
⚫ other Matters relating thereto, before the Judges of Affize and the
• Chairman and other Juftices at Seffions, and great Mifchief has
⚫arifen for want of the fame being regulated and duly ascertained :
And whereas great Benefit would accrue from the due Regulation
thereof;' Be it therefore enacted, by the King's moft Excellent
Majesty, by and with the Advice and Confent of the Lords Spiritual
and Temporal, and Commons, in this prefent Parliament assembled,
and by the Authority of the fame, That no other or higher Fees than
thofe enumerated in the Schedule herein-after fet forth, fhall hence-
forward be payable on Criminal Profecutions, or any other Matter or
Thing relating thereto, in any County, County of a City, County of
a Town, or other Place in that Part of the United Kingdom of Great
Britain and Ireland called Ireland, to any of the Officers therein
mentioned; that is to say:

To the Clerk of the Crown, or his Deputy, for each
Person that fhall be indicted and tried for High
Treason

To the fame, for each Person that shall be indicted and
tried for Petty Treafon or Murder

To the fame, for each Perfon that shall be indicted and
tried for Felony or other Offence

To the fame, for each Perfon whofe Trial shall be
poftponed to a fubfequent Affizes, or other Time for
opening and holding a fresh Commiffion of Affizes or
Oyer and Terminer, Half the Fees that he is hereby
entitled to charge on the foregoing Offences; and in
cafe the Perfon charged by the Indictment fhall post-
pone his Trial, he is to pay the fame himself; and in
cafe the Trial fhall be poftponed by the Crown or
Profecutor, then the faid Half Fees are to be pre-
fented off the County at large, in the fame Manner
that the Fees of the Prifoners acquitted are made
payable as hereafter mentioned.

II. And be it further enacted, That if any Clerk of the Crown, Penalty on taking higher Fees, 101. Clerk of the Peace, or any of their Deputies, Sheriff or Under Sheriff, Gaoler or Under Gaoler, or Turnkey, or Crier at Affizes or Seffions, or other Person acting under them, or any of them, shall demand, take, or accept, any other or higher Fee than the Sum or Sums ftated and fet forth in the foregoing Schedule, for the feveral Matters and Things therein contained and specified, or for or on account of any other Matter or Thing whatfoever relating thereto, each and every fuch Person so offending fhall for each and every fuch Offence forfeit the Sum of Ten Pounds Sterling, to be recovered in any of His Majefty's Courts of Record in Dublin, by Action of Debt, Bill, or Plaint, in which no Effoign, Protection, or Wager of Law, or more than one Imparlance, fhall be allowed, or by Civil Bill, to be heard and determined by the Affitant Barristers at the Seffions of the Peace in fuch Counties as the faid Offences fhall be committed.
