VII. And, for fecuring the more regular and ípeedy Application by the Treasurers of the feveral Counties, Counties of Cities and Towns in Ireland, of all Fines impofed at the feveral Aflizes or Prefenting Terms on Parifhes, Townlands, Manors and Lordships, on account of any unlicensed Still, or Part of a Still, or Appendage to a Still, or any Worm or other Utenfil for dittilling of Spirits, or any Wafh, Pot Ale, Low Wines or Singlings, having been found ufed in any Place within any fuch Parish, Townland, Manor or Lordship,' Be it enacted, That from and after the Twenty-fourth Day of June, One thoufand eight hundred and nine, it fhall not be lawful for any Court or Judge at any Affizes or Presenting Term in any County, County of a City or Town in Ireland, to fiat any Prefentment for the Salary of or for any per Ceutage or Allowance payable to the Treasurer of fuch County, County of a City or Town, unlefs fuch Treafurer fhall at fuch Affizes or Pretenting Term produce to fuch Court or Judge upon Oath, which Oath fuch Court or Judge is hereby empowered and required to adminifter, a full, feparate, and true Account of the Receipts and Payments by fuch Ticafurer on account of all fuch Fines as fhall have been imposed on any Parish, Townland, Manor or Lordship, for the Caufes before mentioned, or any of them, at any preceding Affizes for fuch Courty, County of a City or Town, (or Prefenting Term, if for the County of Dublin,) and as fhall not have been previously paid and accounted for by fuch Treasurer; and alfo, unless it fhail appear by fuch Account that no Part of the Monies received by him on account of fuch Fines remains in his Hands unapplied; except in Cafes where the fame has not been demanded of him or at his Office by the Perfons entitled to receive the fame, all which Cafes fhall be verified by the said Treasurer on Oath; and except in Cafes where it fhall appear that an Information has been lodged against the feizing Officer for fraudulent Practices, in any which Cafe it fhall be lawful for the faid Treasurer to withhold the faid Sum or Sums fo claimed by faid Officer, until fuch Information fhall be tried or otherwife difpofed of; and in cafe the faid fizing Officer fhall be convicted thereon, fuch Treasurer fhall pay over every fuch Sum and Sums to the Churchwardens of fuch

VIII. And be it further enacted, That if any Action or Suit fhail Time be brought or commenced against any Treafurer of any County, County of a City or County of a Town in Ireland, by any Officer of Excife, or by any other Perfon or Perfons, or by or on behalf of the Governors of the Public Infirmary or Hofpital of the County, Town or City, or by or on behalf of the Society for difcountenancing Vice and promoting Virtue, or by or on behalf of His Majefty, his Heirs or Succeffors, for any Share or Proportion of any fuch Fines impofed for the Caufes laft before-mentioned, or any of them, which fuch Officer or Perfon, or Governors of fuch County Infirmary, or Hofpital or Society, or which His Majefty, his Heirs or Succeffors, may by Law be entitled to receive or recover, or for any Cofts which ought by Law to be paid by fuch Treasurer out of any Money in his Hands arifing from any fuch Fine; and if the Plaintiff in fuch Action fhail obtain a Verdict or Judgment against fuch Treafurer, fuch Plaintiff fhall be entitled to his or their Treble Cofts. to be awarded against fuch Treasurer, and to be recovered in fuch Manner as Colts may by Law be recovered against any Defendant.

IX. And be it further enacted, That from and after the faid Collectors fhall Twenty-fourth Day of June One thousand eight hundred and nine, not receive it fhall not be lawful for any Court or Judge at any Affizes (or Pre-Pondage or Wages unless fenting Term, if in the City of Dublin) to difcharge any Quere on they have any Prefentment for the Poundage or Wages of any Collector or collected all High Conftable acting as a Colle&tor for any Barony, Half Barony, fuch Fines. or County of a City or County of a Town, or to allow in the Accounts of the Treasurer any Sum of Money on account of Poundage or Wages of any fuch Collector or High Conftable, nor fhall any fuch Collector or High Conftable in his Accounts with the Treafurer of the Sums levied by him, detain, keep, or claim Credit for, to his own Ufe, any Sum by way of Poundage or Wages for any Money he shall have collected fince the preceding Affizes or Prefenting Term, unless fuch Collector or High Constable fhall, before the Commiffion Day of fuch Affizes, or the First Day of fuch Prefenting Term, have collected and paid to fuch Treasurer the full Amount of all fuch Fines imposed on any Parish, Townland, Manor or Lordship, under the faid recited Acts, of the Forty-feventh and Forty-eighth Years aforefaid, or under this Act, as fuch Collector fhall have been authorized or required to collect by the Warrant of any fuch Treasurer, to be iffued after the paffing of this Act, at any Time after the Affizes or Presenting Term then next preceding.

X. And be it further enacted, That whenever any Juftice of the Proof of figning Peace fhall take or receive any Information for any Offence relating of Information to any unlicensed Still, or Part of a Still, or Appendage to a. Still, and Notice by or any Worm or Utenfil for diftilling Spirits, or any Wah, Pot Ale, Low Wines, or Singlings, under the Directions and Provifions of the faid recited Act made in the Forty-feventh Year of His prefent Majefty's Reign, intituled, An Act to amend an A& made in the Forty-fixth Year of His prefent Majefty, for the regulating and fecuring the Collection of the Duties on Spirits diftilled in Ireland; or under the Directions or

A.D. 1809. Provifions of any A& or As for amending the faid recited A& in force in Ireland at the Time of fuch Information, or fhall fign any Notice of fuch Information to be ferved upon the Inhabitants of any Parish, Townland, Manor or Lordship, pursuant to the Directions of any fuch A&t or Acts, Proof of the Hand-writing of fuch Juftice to fuch Information or Notice refpectively, by the Oath of any One credible Witnefs, fhall be deemed fufficient Evidence that fuch Infor. mation was taken and fo figned by fuch Juftice, or that fuch Notice was fo figned by fuch Juftice refpectively as aforefaid.

XI. And be it further enacted, That from and after the Expiration Perfons infuring of Thirty Days after the paffing of this Act if any Perfon what foever fhall infure or take, or agree to take, or receive any Sum of Money, or Security for Money or Depofit for the Infurance of, or be in any Way concerned in any Partnership, Fellowship, Club, Office or Society for the Infurance or Indemnity of any Parish, Townland, Manor or Lordship, or of any Perfon or Perfons, againft or from the paying of any Money for or towards the discharging of any Fine which may be impofed on any Parish, Townland, Manor or Lordship, or on any of the Inhabitants thereof, on account of any unlicensed Still, or Part of a Still, or Appendage to a Still, or any Worm or other Utenfil for diftilling of Spirits, or any Wafh, Pot Ale, Low Wines, or Singlings, having been found or used in any Place within fuch Parish, Townland, Manor or Lordship; or if any Perfon or Perfons fhall give or pay, or caufe to be given or paid, to any other Person or Perfons any Money, or any Security, Obligation or Undertaking, to pay any Money, or make any Depofit with fuch Perfon or Perfons, as an Indemnity or Security againft, or to be applied in the Payment and Satisfaction of any fuch Fine, or in any Way to indemnify fuch Parish, Townland, Manor or Lordship, or the Inhabitants thereof, or any of them, against the Payment of any fuch Fine or any Part thereof; then and in every fuch Cafe every Perfon concerned or engaged in any fuch Infurance or other Transaction aforefaid, as well the Perfon who shall fo infure, or who fhall pay a Depofit, as the Perfon who fhall accept, take or receive any fuch Sum of Money, or any fuch Security, Obligation, Undertaking, or Indemnity as aforefaid, fhall be deemed and taken to be guilty of a Misdemeanor; and it fhall be lawful for any Juftice of the Peace, refiding near to the Place where fuch Offence shall be com. mitted, on Information on Oath of any fuch Offence, to iffue his Warrant for the Apprehenfion of fuch Perfon, and, on Examination into the Complaint, to commit fuch Perfon to Gaol, there to remain until delivered by due Courfe of Law; and in cafe any Indictment fhall be found against fuch Perfon, fuch Perfon fhall plead thereto without having Time to traverse the fame; and it shall be lawful for the Court, by and before whom such Person fhall be tried and convicted, to inflict fuch Punishment on fuch Perfon as may by Law be inflicted on Perfons guilty of Misdemeanors.

XII. And whereas it may tend to the Suppreffion of illicit Diftil⚫lation if Parishes were allowed to appoint certain Perfons for the Purpose of discovering and preventing fuch Practices;' Be it enacted, That from and after the paffing of this Act, it fhall and may be lawful for the Churchwardens of any Parish, at the Defire of any Two Inhabitants of fuch Parish, to convene a Vestry for the Purpofe of electing One or more Perfon or Perfons for the Purpose of difcovering and profecuting all Offences against any Act or Acts in force in Ireland,

for the regulating and fecuring the Collection of the Duty on Spirits in Ireland, of which Ten Days Notice fhall be given.

XIII. And be it further enacted, That all Perfons fo chofen, and Oath of Perfons who fhall confent to act, fhall take the following Oath before any One fo appointed, Magiftrate or Juftice of Peace, which Oath fuch Magiftrate or Justice

XIV. And be it further enacted, That it fhall and may be lawful Parishes may for the Parishioners of fuch Parish in Veftry so affembled, to affefs raife Twenty Pounds a Year fuch Parish to the Amount of any Sum not exceeding Twenty Pounds for fuch in any one Year, to be applied in the indemnifying of fuch Inspectors Infpectors, &c. for their Trouble and Expence, and a fo for the Purpose of carrying into Execution this prefent A&t and all other Acts for the Prevention and Suppreffion of illicit Diftillation in Ireland.

XV. And be it further enacted, That from and after the Twentyninth Day of September One thousand eight hundred and nine, when ever any Grocer, or Perfon exercising the Trade and Bufinefs of a Grocer, or who fhall be licenfed as a Grocer, fhall also be licensed to fell Spirituous or other Liquors by Retail, according to the Provifions in Quantities of an A&t made in the Forty-feventh Yar of His prefent Majefty's from Two Reign, intituled, An Act to make further Regulations with respect to Licences for the Sale of Spirituous and other Liquors by Retail in Ireland; it fhall and may be lawful for fuch Grocer, or fuch Perfon as aforefaid, without having or obtaining any other Licence for the Purpose, to fell Spirituous Liquors in any Quantities not lefs than Two Quarts and not exceeding Fifty Gallons; any Thing in any Act or Acts in force in Ireland to the contrary notwithtanding.

XVI. And be it further enacted. That if any Brazier, Tinman, or Penalty on Worker of Tin, or other Perfon dealing in Brafs, Copper, Tn or other Metal, fhall at any Time after the Expiration of Ten Days after the Day of the paffing of this Act, make or repair, or have in his or her Poffeffion in Ireland, any Still whatever not made of Copper, or fhall make or repair, or have in his Poffeffion any Still, the Content of the Body whereof, without the Head or any other Appendage thereto, fhall be lefs than Fifty Gallons (other than and except Stills of the Dimensions allowed by Law to be ufed by Rectifiers or Compounders, or at Apothecaries' Hali in Dublin, or by fome Chemift, Apothecary, Druggift, or Perfon duly licensed, for the making or keeping of which laft-mentioned Stills, fuch Brazier or other Perfon aforefaid fhall have obtained a Licence according to Law;) or if Brazier or Perfon working in Copper, Brafs, or Tin, fhall after the faid Time wilfully omit, negle, or refufe to make a true Return, verified by Affidavit, to the Collector of the District in which such Brazier or other Person aforefaid fhall refide, of the Name and Place of Abode of every Perfon for whom fuch Brazier or other Perfon as aforefaid fhall make or repair any Still, Still Head, or Worm, or to whom fuch Brazier fhall feil or deliver any Still, Still Head, or Worm, before fuch Brazier shall suffer the fame to be taken or delivered out

XVII. And be it further enacted, That if any Perfon who fhall be licenfed to fell Spirituous and other Liquors by Retail in Ireland, fhall at any Time or Times after the Twenty-fourth Day of June One thoufand eight hundred and nine, knowingly receive into or have in his or her Cuftody or Poffeffion, or fhall knowingly fell or difpofe of any Spirits diftilled in Ireland, on which all Duties fhall not have been fully paid and fatisfied; or any Spirits which fhall have been made or diftilled by any Perfon, or in any Place not duly licensed according to Law for that Purpofe; every fuch Retailer fo offending fhall for every fach Offence forfeit the Sum of One hundred Pounds, and the Licence previously granted to fuch Retailer fhall be and become ipfo fallo, void; and every fuch Retailer who, after fuch Licence thall become void, fhall retail any Spirituous Liquors, or other Liquors, fhall be liable to all fuch Pains and Penalties as by any A&t or Acts in force in Ireland are inflicted on Perfons felling Spirituous or other Liquors by Retail, without being duly licenfed for that Purpose.

XVIII. And whereas by an Act made in the Forty-fitth Year of His prefent Majefty's Reign, intituled, An Ad for regulating Licences for the Sale of Spirituous Liquors, Wine, Beer, Ale, and Cyder, by Retail, and for difcouraging the immoderate Ufe of Spirituous Liquors in Ireland, it is among other Things enacted, That, in cafe at any Special or General Seffions no Order shall be given for iffuing Licences in Manner prefcribed in the faid recited Act, or in cafe no Order fhall be given thereat for iffuing Licences in any particular Barony or Half Barony, it fhall be lawful for the Clerk of the Peace to iffue a Licence to any Perfon or Perfons whom any Two Magiftrates. of the County, refiding within Five Miles of the Habitation of fuch Perfon, fhall certify to be a proper Person for being entrusted with the Sale of Spirituons and other Liquors at fuch Place as fhall be mentioned in fuch Certificate;' Be it enacted, That fo much of the faid lat recited A&t as is herein-before rehearfed and fet forth, fall, from and after the paffing of this Act, be and the fame is hereby repealed.

XIX. And be it further enacted, That if any Person shall apply for a Licence to fell Spirituous and other Liquors by Retail, under the Provifions of the faid laft-recited Act of the Forty-fifth Year, or any Act for amending the fame, at any Special or General Seffions which fhail be held at any Place more than Seven Miles diftant from
