XXIII. And be it further enacted, That from and after the Ter mination of the War by the Ratification of a Definitive Treaty of Definitive Treaty Peace, it fhall and may be lawful for the United Company of Merof Peace, Eaft chants of England trading to the East Indies, to expofe to Sale either India Company for the Purpole of being worn or used in Great Britain, or for ExportaHome Confump- tion, any Silk Handkerchiefs of the Manufacture of Perfia, China, tion or Exporta- or the Eaft Indies, that fhall have been or may thereafter be fecured in the Warehouses of the faid United Company, fubje&t nevertheless to the Duties by this Act impofed, or which may hereafter be impofed thereon; and all fuch Silk Handkerchiefs on which fuch Duties fhall have been duly paid, fhall and may be worn or used in Great Britain, or fold or expofed to Sale therein, and shall not be fubject to Seizure or Forfeiture, nor fhall the Perfon or Perfons who fhall wear or use the fame, or who fhall fell or expofe to Sale the fame, or have the fame in his, her, or their Cuftody or Poffeffion, be liable to any Penalty or Penalties, or Fine or Fines whatever on account thereof, any Law, Cuftom, or Ufage, to the contrary notwithstanding.

XXIV. Provided always, and be it further enacted, That for the Space of Taree Years from and after the faid Ratification, the said United Company fhall not, in any One Year, fell or expose to Sale a greater Quantity of fuch Silk Handkerchiefs than Fifty thousand Pieces, and that fuch Fifty thousand Pieces fhall be of the ufual Length, and of the Sorts that shall have been ufually exposed to Sale. XXV. And Whereas certain Bounties are allowed on the Exportation of Refined Sugar, produced from Raw Sugar imported from the British Plantations in America: And Whereas it is expedient that the like Bounties fhould be allowed on the Exportation of Refined Sugar produced from Sugar imported by the United Company of Merchants of England trading to the East Indies; Be it therefore enacted, That from and after the faid Filth Day of July One thousand eight hundred and nine, there shall be paid and allowed on the Exportation of Refined Sugar produced from Sugar imported by the United Company of Merchants of England trading to the Eaft Indies, tre like Bounty as is now or hereafter may be allowed by Law on the Exportation of the like Sort or Description of Refined Sugar, produced from Raw Sugar imported from the Britifb Piantations in America, fubject in every Refpe&t to the Conditions, Rules, Regulations, Restrictions, Penalties, and Forfeitures, now by Law practifed and applied with refpect to the Bounty allowed on the Exportation of Refined Sugar.

XXVI. And be it further enacted, That in all Cafes where by the Schedule and Tables hereunto annexed the Duties of Cuftoms by this A&t impofed upon the Importation of Goods, Wares, and Merchandize into Great Britain, are charged, not according to the Weight, Tale, Gauge, or Mcafure, but according to the Value thereof, fuch Value fhall be taken and confidered as the fame shall be at the Port of Importation, without any Abatement or Deduction whatever, except of fo much as the Duties payable on the Importation thereof by this

A&t shall amount to, and that fuch Value shall be ascertained (except as in this Act is provided) by the Declaration of the Importer or Proprietor of fuch Goods, Wares, or Merchandize fo imported, or of his known Agent or Factor, in the Mammer and Form, and under all the Rules and Regulations, and subject to the Rules and Regulations, and fubject to the fame Forfeitures and Penalties, as are prefcribed, directed, and impofed for afcertaining and collecting Duties to be paid according to the Value thereof, by an A&t paffed in the Twenty-feventh Year of the Reign of His prefent M-jefty, intituled, An Ad for repealing the feveral Duties of Cuftoms and Excife, and granting other Duties in lieu thereof, and for applying the faid Duties, together with the other Duties com. pofing the Publick Revenue; for permitting the Importation of certain Goods, Wares, and Merchandize, the Produce or Manufacture of the European Dominions of the French King, into this Kingdom: and for applying certain unclaimed Monies remaining in the Exchequer for the Payment of Annuities on Lives to the Reduction of the National Debt, and in cafe fuch Goods, Wares, or Merchandize, fhall not be valued according to the true and real Value thereof, and according to the true Intent and Meaning of this Act, then it fhall be lawful for the proper Officer or Officers of the Customs to cause the fame to be detained, and the faid Goods, Wares, or Merchandize, fhall be dealt with, and the proper Officers of the Cuftoms fhall proceed in every Respect in the Manner prescribed in fuch Cafe by the said recited A&t.

XXVII. And be it further enacted, That in all Cafes where, by the Schedule annexed marked A. the Duties of Customs by this A&t impofed upon the Exportation of Goods, Wares, and Merchandize from Great Britain, and charged, not according to the Weight, Tale, Gauge, or Measure, but according to the Value thereof, fuch Value fhall be taken and confidered as the fame fhall be at the Port of Exportation, without any Deduction or Abatement whatever, except of fo much as the Duties of Cuftoms paid or payable thereon at the Time of the Entry of fuch Goods, Wares, and Merchandize fhall amount to, and that fuch Value fhall be afcertain d (except as in this Act is provided) by the Declaration of the Exporter or Proprietor of fuch Goods, Wares, and Merchandize, or of his known Agent or Factor, in the Manner and Form, and under all the Rules, Regulations, and Restrictions, and fubje&t to the fame Forfeitures and Penalties as are preferibed, directed, and impofed for afcertaining and collecting the Duties to be paid according to the Value thereof, by the faid recited A&t paffed in the Twenty-leventh Year of the Reign of His prefent Majefty; and in cafe any Goods, Wares, or Mer. chandize fhall not be valued according to the true Intent and Meaning of this Act, then it shall be lawful for the proper Officer or Officers of the Cuttoms to cause the same to be detained, and the said Goods, Wares, or Merchandize shall be dealt with, and the proper Officers of the Customs fhall proceed in every Refpect except as herein after is provided, in the Manner prefcribed in fuch Cafe by the faid recited A&.

XXVIII. A.D.1809. chandize, according to the Declaration made on the Entry thereof for Exportation, together with the Amount of the Cuftoms paid thereon, at the Time of the Entry thereof, without any further Allowance whatever; any Thing in the faid recited A&t pafled in the Twenty feventh Year of His prefent Majefty, or in any other Act or Acts of Parliament to the contrary thereof notwithstanding.

XXIX. And be it further enacted, That if at the Time of making the Entry for the Exportation of any Goods, Wares, or Merchandize, of the Growth, Produce, or Manufacture of Great Britain, on which the Duties of Cuftoms by this Act granted, are charged in the Schedule hereunto annexed marked (A.), according to the Value thereof, the Exporter or Proprietor of fuch Goods, Wares, or Merchandize, fo entered for Exportation, his known Agent or Factor fhall not be able to afcertain the true and real Value thereof, it fhall be lawful for the Collector and Comptroller of the Cuftoms at the Port of Exportation, to permit fuch Exporter or Proprietor, Agent or Factor, to ship or export fuch Goods, Wares, or Merchandize, upon making Oath that fuch real Value cannot be afcertained, and upon Bond being given either by the Exporter or Proprietor of fuch Goods, Wares, or Merchandize, or by the known Agent or Factor of fuch Exporter or Proprietor, to His Majefty, His Heirs and Succeffors, with one fufficient Surety in Treble the Amount of the fuppofed or estimated Duty on the Value of fuch Goods, Wares, or Merchandize, conditioned for the Payment of the Duties hereby impofed, within Three Months, and according to the true and real Value thereof, and for producing the Invoice and Bills of Parcels, or fuch other Documents as shall be required by the Collector and Comptroller of the Customs at the Port of Exportation, in cafe the Production thereof shall be thought neceffary by fuch Officers of the Cuftoms, for the Purpose of afcertaining the true and real Value of fuch Goods, Wares, or Merchand ze, fo exported as aforefaid.

XXX. Provided always, and be it further enacted, That upon the Exportation of all Goods, Wares, and Merchandize, of which the real Value cannot be afcertained, and in Cafes where the Duties are allowed to be secured by Bond as aforefaid, the Name of the actual and real Exporter, whether fuch Exporter fhall be the Proprietor or the Agent or Factor of the Proprietor, fhall be declared in the Entry, together with the Name of the Agent or Factor making the Entry, and giving fuch Bond, and the Declaration of the Value of fuch Goods, Wares, and Merchandize, according to which the Duties fhall be ascertained and paid, and the Bond cancelled, fhall in all such Cafes be figned by fuch actual and real Exporter, and not by any Clerk, Agent, or Broker, of fuch Exporter.

XXXI. And be it further enacted, That if any Exporter of any fuch Goods, Wares, or Merchandize, entered for Exportation, fhall knowingly and fraudulently make any falfe Declaration of the Value of any fuch Goods, Wares, or Merchandize, after the fame fhall have been allowed to be shipped for Exportation, every fuch Exporter fhall for every fuch Offence forfeit a Sum equal to the true and real Value of all fuch Goods, Wares, or Merchandize.

XXXII. And be it further enact d, That in cafe any Goods, the Cuftoms may Wares, or Merchandize upon which Duties of Customs are hereby imposed, shall be detained by any Officer of the Customs on account of the fame not being valued according to the true and real Value thereof,

thereof, and according to the true Intent and Meaning of this Act, be delivered, &c. it hall and may be lawful for the Commiffioners of His Majefty's Customs in England for the Time being, or any Four or more of them, and the Commiffioners of His Majefty's Cuftoms in Scotland for the Time being, or any Three or more of them, upon Proof being made to their Satisfaction that no Fraud was intended, to direct the Goods to be delivered, and the Entry to be amended, upon fuch Terms and Conditions as under the Circumftances of the Cafe fhall appear to the faid Commiflioners of the Cuftoms in England and Scotland refpectively to be reasonable, and as they fhall think fit to direct: Provided Proprietor shall always, that if the Importer, Exporter, or Proprietor of fuch Goods, not have Wares, or Merchandize, fhall accept the Terms or Conditions Damages. prefcribed by the faid Commiffioners of the Cuftoms refpectively, fuch Importer, Exporter, or Proprietor fhall not have or be entitled to anv Recompence or Damage, on account of the Detention of fuch Goods, Wares, or Merchandize, or have or maintain any Action whatever for the fame; any Law, Cuftom, or Ufage to the contrary notwithstanding.

XXXV. And be it further enacted, That from and after the Fifth Day of July One thousand eight hundred and nine, no Wine of any Sort fhall be admitted to Entry for Prifage either in the Port of London or either of thofe Ports in England where the Right of Prisage has been fo purchased as aforefaid, but that Wine imported into London, or either of the said Ports, fhall from and after the faid Fifth Day of July One thoufand eight hindred and nine, be subject and liable to the Duties of Cultoms, and no other, as in Cafes of regular Importation, as the fame are defcribed and fet forth in Figures in the Schedule to this Act annexed, marked (A).

in certain Ports to Entry for Prifage, but fhall pay Duties of regular Importation,

XXXVI. And be it further enacted, That from and after the Fifth After 5 July Day of July One thoufand eight hundred and nine, the Duty called 1809, Butlerage Butlerage, ad the Money formerly received by any or either of the Duty thall cease. Deputies of the faid Duke of Grafton, or any other Perfon for him or them under the Denomination of Compofition, fhall cease, determine, and he no longer due and payable.

XXXVII. And be it further enacted, That before any Blubber, On Entry of Train Oil, or Spermaceti Oil, or Head Matter, or Whale Fins, im- Blubber and Oil, ported into Great Britain, as being the Produce of Fish, or Creatures &e. as imported living in the Sea, taken and caught by the Crew of a British-built in British Ships Ship or Veffel wholly owned by His Majefty's Subjects, ufually and taken by British Subjects, residing in Great Britain, Ireland, or the Islands of Guernsey, Jersey, Oath fhall be Alderney, Sark, or Man, registered and navigated according to Law, made of the fhall be admitted to Entry on Payment of the Duty by this A&t Facts, &c. impofed on fuch Blubber, Train Oil, Spermaceti Oil, Head Matter, or Whale Fins refpectively when imported in fuch Shipping, the Mafter or other Perfon having or taking the Charge or Command of

the Ship or Veffel in or on board of which the faid Articles fhall be imported, fhall make Oath before the Collector or Comptroller, or other Chief Officer of the Cuftoms at the Port in Great Britain into which the fame fhall be imported, who is hereby authorized and required to adminifter the fame, that the fame was or were bonâ fide the Produce of Fish or Creatures living in the Sea, a&tually taken and caught by the Crew of any fuch Ship or Veffel; and the Importer, or Proprietor, or Confignee of fuch Blubber, Train Oil, Spermaceti Oil, or Head Matter, or Whale Fins, fhall also make Oath before the Collector or Comptroller, or other Chief Officer of the Cuftoms, (who are hereby authorized and required to adminifter fuch Oath,) at the Time of the Entry, that to the beft of his or their Knowledge and Belief the Articles fo imported were bona fide the Produce of Fith, or Creatures living in the Sea, actually taken and caught by the Crew of a British-built Ship or Veffel, wholly owned by His Majefty's Subjects ufually refiding in Great Britain, Ireland, or the Islands of Guernsey, Jersey, Alderney, Sark, or Mun, registered and navigated according to Law; on Failure whereof the faid Articles fhall be deemed and taken to be of Foreign Fishing, and charged with the Duty impofed by this A&t on fuch Articles of Foreign Fifhery.

XXXVIII. And be it further enacted, That before any Blubber, Train Oil, or Spermaceti Oil, Head Matter, or Whale Fins, imported into Great Britain as being taken and caught on the Banks and Shores of Newfoundland and Parts adjacent, wholly by His Majefty's Subje&s carrying on fuch Fishery from that Ifland, and refiding therein, or as being actually taken and caught wholly by His Majefty's Subjects ufually refiding in any British Colony or Plantation in North America, or ufually refiding in any other British Colony, Plantation, Territory, or Settlement, fhail be admitted to Entry on Payment of the Duty by this Act impofed on fuch Blubber, Train Ol, Spermaceti Oil, Head Matter, or Whale Fins refpectively, when imported in a Britishbuilt Ship or Veffel, registered and navigated according to Law, the Mafter or other Perfon having or taking the Charge or Command of the Ship or Vaffel in which the fame fhall be imported, fhill produce and deliver to the Collector or other Chief Officer of the Cultoms of the Port of Importation, a Certificate under the Hand and Seal of the Collector or other Chief Officer of the Cuftoms of the Port or Place in the Colony, Plantation, Territory, or Settlement where the Articles fhall have been taken on board; or if no fuch Officer fhall be retiding there, then a Certificate fhall be produced under the Hand and Seal of the Governor, or in his Abfence under the Hand and Seal of the Deputy-Governor, of fuch Colony, Plantation, Territory, or Settlement, teftifying that Oath had been made before him (who is hereby authorized and required in fuch Cafe to adminifter the fame, and to grant fuch Certificate) by the Matter of the Ship from which the Blubber, Train Oil, Spermaceti Oil, Head Matter, or Whale Fins mentioned in fuch Certificate, had been landed in fuch Colony, Plantation, Territory, or Settlement; that the fame was or were really and bona fide the Produce of Fish or Creatures living in the Sea, actually caught and taken wholly by His Majefty's Subjects carrying on fuch Fishery, and ufually refiding in fuch Colony, Plantation, Territory, or Settlement; and the Mafter or other Person having or taking the Charge or Command of the Ship or Veffet in which the Blubber, Train Oil, Spermaceti Oil, Head Matter, or Whale Fing
