by the Majority of any of the faid Boards refpectively: And whereas in purfuance of the faid recited A&t Ten Commiffioners were duly appointed, but Doubts have arifen what Number of Commiffioners fhall be requifite to conftitute a General Board of Commiffioners, and alfo whether the Majority required by the faid recited A&t for doing any Thing directed to be done by the faid Commiffioners muft be a Majority of Commiffioners actually prefent at a General Board, or the Majority of the whole Number of Ten Commiffioners;' Be it therefore enacted and declared by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That any Five of the faid Commiffioners fhall conftitute a General Board, and fhall have Power to do any A&t, Matter, or Thing, which may be done by the Commiffioners by virtue of the faid recited Act.

II. And be it further enacted, That any Thing which is, under the Authority of the faid recited A&t, or the Acts therein referred to, directed to be done by the faid Commiffioners, may be done by the Majority of the Commiffioners actually present at any fuch General Board, at which not less than Five Members fhail be prefent as aforefaid.

An Act to provide for a durable Allowance of Superannuation to the Officers of Excife, under certain Restrictions.

HEREAS no Provifion whatever is made by the Laws now in force for fuperannuated and worn-out Officers, and other Perfons employed in the Revenue of Excife, to the great Difcouragement of fuch Officers and other Perfons, and the manifeft Injury of the Revenue; for Remedy thereof,' be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the paffing of this Act, it fhall and may be lawful to and for the Lords Commiffioners of His Majefty's Treafury, or any Three or more of them for the Time being, by Warrant under their Hands, to grant and allow out of the Revenue of Excife of England, to any Officer or other Perfon who fhall have been employed in the faid Revenue for and during the Space of Ten Years at the leaft, and who fhall by Age or Infirmity have become incapable of properly executing or performing the Duties of his Office, a Pension, Annuity, or yearly Payment not exceeding Three-fourth Parts of the Average annual Amount of the Salary which fhall have been received by fuch Officer or other Perfon during the whole Period of Seven Years preceding the Refignation of fuch Officer or other Perfon.

II. Provided always, and be it further enacted, That it shall and may be lawful to and for the Lords Commiffioners of His Majesty's Treasury, or any Three or more of them for the Time being, to grant and allow out of the faid Revenue of Excife to any fuch Officer or other Perfon as aforefaid, who, by Accident met with in the Execution of his Duty, fhall be rendered totally incapable of performing the fame, notwithstanding fuch Officer or other Perfon may not have

been

been employed in the Revenue of Excife the full Time before mentioned, a Penfion, Annuity, or yearly Payment not exceeding Threefourth Parts of the annual Amount of the yearly Salary actually received by or payable to fuch Officer or other Perfon, at the Time when fuch Officer or other Perfon fhall have met with the Accident by which he shall have been fo rendered incapable of executing or performing his Duty: Provided alfo, that nothing herein contained fhall extend, or be deemed or conftrued to extend to authorize or empower the Lords Commiffioners of His Majefty's Treasury to grant or allow any Penfion, Annuity, or yearly Payment out of the Revenue of Excife, to any Officer or other Perfon whatever, except fuch Officer or other Perfon only who fhall at the Time of his Refignation have been in the fair and bona fide Receipt, payable out of the faid Revenue of Excife, of at leaft Öne hundred and eighty Pounds per Annum, nor in the Cafe of any Perfon under the Rank of a Commiffioner, until it fhall have been certified to the faid Lords Commiffioners, under the Hands of the Commissioners of Excite, or the major Part of them for the Time being, that fuch Officer or other Perfon claiming or foliciting any fuch Penfion, Annuity, or yearly Payment as aforefaid, is from Age or Infirmity become incapable of properly executing or performing the Duty of fuch his Office or Station, and that he has been employed in the Service of the faid Revenue at leaft Seven Years, and what yearly Salary fuch Officer or other Perfon fhall have received for and during the preceding Seven Years, and that fuch Officer or other Perfon had, during his Employment, fupported the Character of having faithfully discharged the Duties of his Office or Station, or, in cafe of Accident as aforefaid, that fuch Officer or other Perfon has been by fuch Accident rendered totally unable to execute or perform the Duty of fuch his Office or Station; any Thing in this Act to the contrary notwithstanding.

III. And Whereas, for the Relief and Support of the inferior Officers of Excife when fuperannuated or worn-out, certain De⚫ductions have been for many Years laft paft, and are now made under the Directions and Authority of Warrants of the Lords Commif'fioners of His Majefty's Treafury, out of the Salaries of Officers and other Perfons employed in the Revenue of Excife: And whereas the Commiffioners of Excife, to whom the Money arifing by fuch Deductions is entrufted, are prevented from making the greatest Advantage thereof, for want of a Power to veft in fome of the joint Stocks of Annuities transferable at the Bank of England, fuch Part thereof as may not be immediately required to be expended;' Be it therefore enacted, That it fhall and may be lawful to and for the faid For ImproveCommiffioners of Excife, or the major Part of them for the Time ment of Superbeing, to veft in the Purchase of any Share or Shares of any of the joint Stocks of Annuities transferable at the Bank of England, any Sum or Sums of Money which fhall have been or fhall be collected, granted, or appropriated for the Relief and Support of fuch fuper. annuated or worn-out inferior Officers of Excife as aforefaid, and that all and every the Share and Shares of any of the joint Stocks of Annuities transferable at the Bank of England, which fhall from Time to Time be fo bought and purchased by the faid Commiffioners of Excife, or the major Part of them for the Time being as aforefaid, fhall be transferred to the Account and kept in the Books of the Governor and Company of the Bank of England, as the Share and

Shares of and in fuch joint Stocks refpectively, of " the Trustees of the Fund, for the Relief and Support of fuperannuated or worn-out inferior Officers of Excife;" and that the Two Commiffioners of Excife for the Time being who fhall be appointed by Warrant under His Majesty's Sign Manual to prefide at all Meetings of the Board of Excife, and the Secretary to the faid Board for the Time being, fhall have the fole Management, Difpofal, Sale, and Transfer of all the faid Share and Shares of the faid joint Stocks of Annuities fo entered and kept in the Books of the Governor and Company of the Bank of England as aforefaid, and any One or either of them shall from Time to Time receive and give Receipts for all Dividends ariling therefrom: Provided always, that previous to any fuch Two Commiffioners and Secretary tirit acting in fuch Management, Difpofal, Sale, or Transfer, or in the Receipt of fuch Dividends, and allo upon every new Appointment in confequence of the D-ath, Refignation, o Removal of all or any of them. a Warrant fhall for that Purpose be granted to fuch Two Commiffioners and Secretary for the Time being by the Lords Commiffioners of His Majesty's Treafury for the Time being, or any Three of them, and produced to and depofited with the proper Officers of the Governor and Company of the Bank of England, as the Authority for, fuch Management, Difpofal, Sale, or Transfer, or the Receipt of fuch Div.dends.

An Act for repealing the feveral Duties of Cuftoms chargeable in Great Britain, and for granting other Duties in lieu [10th June 1809.] THEREAS by an A&t paffed in the Forty-third Year of the Reign of His prefent Majefty, intituled, An Act to repeal the • Duties of Cufloms payable in Great Britain, and to grant other Duties in lieu thereof; the Duties of Cuftoms were fimplified and confolidated: And whereas many new and additional Duties of Cuftoms have been from Time to Time granted fince the paffing of the said Act, and which for the better afcertaining the annual Produce and Appropriation thereof have been kept diftinct and carried to feparate Accounts, both in the Receipt thereof and in His Majefty's Exchequer, and the Computation of the Duties of Cuftoms has thereby again become complicated and intricate: And Whereas it is expedient for the affording Facility and Accommodation to mercantile Tranf actions, that the feveral Duties of Cuftoms now payable, (except as is herein-after provided,) fhould be again confolidated: And • whereas

whereas it is neceffary for carrying into Execution the Purposes aforefaid, that all fuch Duties (except as in this Act mentioned) ⚫ fhall ceafe and determine, and that other Duties of Customs should ⚫ be granted in lieu thereof: And Whereas it will greatly fimplify the keeping the publick Accounts of the Revenue of Cuftoms, if the Duties were received and accounted for annually in Two Sums only, the one being the Produce and Amount of the Revenue of Customs granted to His Majefty as permanent Additions to the Revenue, and made Part of the Confolidated Fund of Great Britain; and the other being the Produce and Amount of the Duties of Customs and Tonnage granted to His Majefty, during the Continuance of the prefent War, and until certain Periods after the Ratification of a Definitive • Treaty of Peace, and to be fo carried to account in the Exchequer (except as herein-after is provided); and that feparate Accounts for • Ten Years from the refpective Periods at which any of the faid Duties were granted, fhould no longer be kept, but that in lieu thereof, Accounts should be laid before Parliament for fuch refpective Periods as aforefaid, of the Produce of fuch Duties as far as the fame can be afcertained: May it therefore please Your Majefty that it may be enacted; and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the Fifth From 5 July Day of July One thousand eight hundred and nine, all and fingular 1809, the the Subfidies, Cuftoms, Impofitions, or Duties whatever, (refpecting Patoms and prefent Duties of the Revenue of Customs) payable to His Majefty, His Heirs and Succeffors, by virtue of any Act or Acts of Parliament in force, on or immediately before the faid Fifth Day of July One thousand eight hundred and nine, upon the Importation or Exportation respectively, of any Goods, Wares, or Merchandize, into or from Great Britain, or upon any Goods, Wares, or Merchandize, being brought or carried coaft wife, from one Port or Place in Great Britain to any other Port or Place within the fame, (except as in this A&t mentioned,) or upon any Ship or Veffel according to the Tonnage thereof, entering or clearing Outwards or Inwards at any Port within Great Britain, and the feveral and respective Drawbacks allowed upon the Exportation of any Goods, Wares, or Merchandize from Great Britain; and alfo all the additional Impofts or Duties charged upon the Product and Amount of the faid feveral Duties of Cuftoms, fhall ceafe and determine; fave and except in all Cafes relating to the recovering, allowing Except as to or paying any Arrears thereof refpectively, which may on the faid Fifth Arrears, &. Day of July One thoufand eight hundred and nine, remain unpaid, or to any Fines, Penalties, or Forfeitures relating thereto respectively, which fhall have been incurred at any Time before the faid Fifth Day of July One thousand eight hundred and nine: Provided always, that nothing in this Act contained fhall extend or be conftrued to extend to repeal or anywile alter the Duties of Package, Scavage, Baillage, or Portage, or any other Duties payable to the Mayor and Commonalty and Citizens of the City of London, or to the Lord Mayor of the faid City for the Time being, or to any other City or Town Corporate within Great Britain, or any other fpecial Privilege or Exemption, to which any Perfon or Perfons, Bodies Politick or Corporate, is or are now entitled by Law, but the fame fhall be continued as heretofore.

Duties of Package, &c. to the City of London, &c. continued

From July 5, 1909, Duties and Drawbacks in annexed Schedule and

Tables fhall be levied, and allowed in lieu of

former Duties

and Drawbacks.

Duties payable by Weight, &c. fhall be paid in proportion.

Tonnage Duties on Veffels to or from Foreign Parts fhall be paid each Voyage, according to their Regifter under

20 G. §. c. 60.

All Acts relative to the Revenue

of Cuftoms fhall be applied in Execution of this Aft.

II. And Whereas it is neceffary that other Duties of Cuftoms fhould be granted to Your Majefty in lieu of the Duties repealed by this A&t; we Your Majefty's moft dutiful and loyal Subjects the • Commons of the United Kingdom of Great Britain and Ireland in • Parliament affembled, have therefore given and granted to Your Majefty the feveral Duties of Cuftoms herein-after mentioned, and do humbly befeech Your Majefty that it may be enacted; and be it therefore enacted, That from and after the faid Fifth Day of July One thoufand eight hundred and nine, in lieu and ftead of the Subfidies and Duties of Customs hereby made to ceafe and determine, there fhall be raised, levied, collected, and paid unto His Majefty, His Heirs and Succeffors, in ready Money (except as herein-after is provided) without any Difcount whatever, upon Goods, Wares, or Merchandize imported and brought into Great Britain from Parts beyond the Seas, and upon Goods, Wares, or Merchandize exported from Great Britain, and upon Goods, Wares, or Merchandize brought or carried Coaft wife from One Port or Place in Great Britain to any other Port or Place within the fame, and upon Ships or Veffels, according to the Tonnage thereof, entering Outwards or Inwards at any Port within Great Britain, the feveral Duties of Cuftoms as the fame are refpectively inserted, described, and set forth in Figures in the Schedule and Tables hereunto annexed, marked A. B. C. and D. ; and that there fhall also be paid or allowed the feveral Drawbacks of the faid Duties of Cuftoms, as the fame are also refpe&ively inferted, defcribed, and fet forth in Figures in the faid Schedule and Tables marked A. and B.; any Law, Cuftom, or Usage to the contrary not withitanding.

Ill. And be it further enacted, That the Duties granted and impofed by this Act, and made payable according to the Weight, Tale, Gauge, Measure, or Value of any Goods, Wares, or Merchandize charged with fuch Duties, fhall be charged and payable upon any greater or lefs Weight, Number, Quantity, or Value thereof than the Weight, Number, Quantity, or Value particularly inferted, defcribed, and fet forth in the Schedule and Tables hereunto annexed marked A. B. and C. in proportion to the actual Weight, Number, Quantity, or Value of fuch Goods, Wares, or Merchandize.

IV. And be it further enacted, That the feveral Duties of Tonnage hereby impofed on Ships and Veffels entering Outwards or Inwards to or from Foreign Parts, fhali be paid to the proper Officer appointed to receive the fame on the Entry Outwards, and within Fourteen Days after the Report Inwards, each and every Voyage any fuch Ship or Veffel fhall fo enter Outwards or report Inwards at any Port within Great Britain, and that the Tonnage of every fuch Ship or Veffel, being British-built or British-owned, fhall be computed and taken according to the Regifter thereof, under the Provifions of an A& paffed in the Twenty fixth Year of His prefent Majefty's Reign, intituled, An Ad for the further Increafe and Encouragement of Shipping and Navigation, and that the Tonnage of every other Ship or Veffel, in cafe of any Doubt or Difpute relative thereto, fhall be ascertained by Admeasurement, in the Mode and Manner prescribed and directed by the faid A&.

V. And be it further enacted, That every Act of Parliament in force on and immediately before the Fifth Day of July One thousand eight hundred and nine, by which any Rules, Regulations, Conditions,
