XLV. And be it enacted, That fo much of the faid recited Act as relates to the Qualification and Appointment of Deputy-Lieutenants 43 G. 3. c. 69. in the Counties of Bute and Sutherland, and alfo fo much of the faid Act as prevents a Substitute trom being received for any ballotted Man in the Militia of Scotland, which Substitute fhall have more than Two lawful Children at the Time he shall be produced to be enrolled, fhall not be repealed, but fuch Act, fo far as regards the fame, shall remain in force in the fame Manner as if this A&t had not been made: Provided always, that no Allowance under this A&t fhall be ordered to be paid to the Family of any Subftitute, hired Man, or Volunteer to be enrolled after the paffing of this Act, who fhall at the Time of his Enrolment have more than Two lawful Children, or who shall have fraudulently reprefented and declared that he had no Wife at the Time of his Enrolment, or who fhall have fraudulently and falfely represented and declared at the Time of fuch Enrolment, that he had not more than Two lawful Children.

We of King Richard the Second, it is among other

HEREAS by a Statute made in the Eighth Year of the 8 R. 2. c.

Things enacted, That no Man of Law fhall from thenceforth be Juftice of Affizes in his own Country: And whereas by an A& ⚫ made in the Thirty-third Year of King Henry the Eighth, intituled, • An A& that none fhall be Juflice of Affize in his own Country, it is enacted, That no Juftice nor other Man learned in the Laws of this Realm fhall ufe nor exercife the Office of Justice of Affize within any County where the faid Juftice was born or doth inhabit And whereas a Compliance with the aforefaid Provifions has been ' attended with very great Inconveniences; for Remedy whereof,' be it enacted by the King's moft Excellent Majefty, by and with

the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That it fhall and may be lawful from Time to Time and at all Times hereafter, to and for the Chief Juftice and Juftices of either Bench, and to and for the Chief Baron and other Barons of the Court of Exchequer, and to and for any other Perfon or Perfons learned in the Law, who fhall be appointed Juftice or Juftices of Affize in any County or Counties within that Part of Great Britain called England, to ule and exercife the Office or Offices of Juftice or Juftices of Affize, and to act under any Commiffion of Nifi Prius in any fuch County or Counties, notwithstanding they or any of them fhail have been born or do inhabit within any fuch County or Counties; and that they fhall not be liable for fo doing to any Forfeiture or Penalty whatsoever, any Thing in the faid recited Laws or either of them, or any other Law, Cultom, or Ufage to the contrary in any wife notwithilanding.

WHEREAS it is expedient that a Part of the Loan or Loans raised for the Service of Great Britain for the prefent Year, and alfo the Sum of Seven millions nine hundred and thirty-two ⚫ thousand one hundred Pounds in Exchequer Bills, funded purfuant to an A&t of this Seffion of Parliament, fhould be charged upon the feveral Duties granted to His Majelty during the Continuance of the prefent War, and until certain Periods after the Ratification of a Definitive Treaty of Peace, except the Duties granted by as Act of the Forty fixth Year of His Majefty's Reign, intituled, An Act for granting to His Mejefly during the prefent War, and until the Sixth Day of Apri next after the Ratification of a Definitive Treaty of Peace, further additional Rates and Duties in Great Britain on the Rates and Duties on Profits arifing from Property. Profeffions. Trades, and Offices; and for repealing an det paffed in the Forty-fifth Year of His prefent Majefly for repealing certain Parts of an Act made in the Forty-third Year of Hs prefent Majefly, for granting a Contribution the Profits arifing from Property.
