extend to charge or to authorize the deducting from or affeffing any Perfon in any Cafe in which the Salary. Wages, Fees, Perquifites or Gratuities payable in refpect of fuch Office or Employment of Profit, or in which the Annuity, Penfion, Stipend, or other Annual Payment shall have been specially exempted from the Payment of any Aids or Taxes by any Act of Parliament, or in any Cafe in which any Salary, Wages, or Stipend of any Office or Employment, or any other Annual Payment which fhall be payable to fuch Perfon in respect of fuch Office or Employment, or of his having held any fuch Office or Employment, fhall by any Order of His Majefty in Council, or by any Warrant under his Majefty's Royal Sign Manual, or by any Order of the Commiffioners of the Treasury, have been directed to be paid net or without Deduction, or in any Cafe in which the Sums aff ffed on any fuch Saary, Wages, Stipend or Annual Payment fhall by like Order of the Commiffioners of the Treafury have been directed to be repaid or reimbursed to the Perfon affeffed, out of any Part of the Publick Revenue of Great Britain: Provided always, that the Authority for the Payment, net or without Deduction, of the Salary, Wages, Stipend or Annual Payment, or the Repayment of the Duty affeffed on the Salary, Wages, Stipend or Annual Payment aforesaid, fhall be refpectively certified by fome principal Officer in the Department to which fuch Officer or Employment belongs, to be fo paid net or without Deduction, or to be repaid out of the faid Revenue. XXXVII. XXXVIII. And Whereas by the faid A&, paffed in the Thirty- Duties on Sugar eighth year of the Reign of His prefent Majefty, intituled, An Ad granted by •for making perpetual, fubject to Redemption and Purchase in the Manner 27 G. 3. c. 13. therein flated, the feveral Sums of Money now charged in Great Britain as a Land Tax, for One Year, from the Twenty-fifth Day of March One thousand feven hundred and ninety-eight, it was enacted, that the • feveral Duties impofed on Sugar by Three Acts of the Twentyfeventh, Thirty-fourth, and Thirty-feventh Years of the Reign of His prefent Majefty, on Malt, by an Act made in the Twenty-feventh Year of the Reign of His prefent Majefty, and the Duties of Excife • on Tobacco and Snuff, by an Act made in the Twenty-ninth Year of the Reign of His prefent Majefty, fhould continue in Force until the Twenty-fifth Day of March One thoufand feven hundred and ninety-nine, and no longer, but fhould from thenceforth ceafe and • determine unless the fame fhould be fpecially continued by Parliament, • which faid several Duties were by an Act made and paffed in the Thirty-ninth Year of the Reign of His prefent Majefty, entituled, 1810. • An act for continuing and granting to His Majefly a Duty on Penfions, [See 49 G. 3. XXXIX. And be it further enacted, That there fhall be provided and kept in the Office of the Auditor of the Receipt of His Majefty's Exchequer, One Book of Regifter, in which all the Money that fhall be paid into the Exchequer for the faid Rates and Duties hereby granted on Sugar, Malt, Tobacco. and Snuff; and alfo the Rates and Affeffiments hereby granted on Perfonal Eltates, and on Offices and Employments of Profit, Penfions, Annuities, and Stipends, hereinbefore mentioned, fhall be entered and registered apart, and diftin& from all other Monies paid and payable to His Majefty.

XLI. And be it further enacted, That ali and every the Claufes, Providoes, Powers, Privileges, Advantages, Penalties, Forfeitures, and Ditabilities, contained in the faid recited A&t made in the Forty-eighth Year of the Reign of His prefent Majefty, intituled, An A for regulating the iffing and paying off Exchey er Bills, fhall be applied and extended to the Exchequer Bills to be made in parfuance of this A&, as fully and effectually, to all Intents and Purpoles, as if the faid feveral Clanfes or Provifocs had been particularly repeated and reenacted in the Body of this Act.

§ 30.

XLIII. And be it declared and further enated, That it fhall be lawful for the Governor and Company of the Bank of England, to advance or lend to His Majefty, at the Receipt of the Exchequer, advance upon the Credit of the Exchequer Bills authorized by this Act. Sum or Sums of Money not exceeding in the Whole the Sum of Three Millions, any Thing in an Act, made in the Fifth and Sixth Years of 5 & 6 Gul. and the Reign of King William and Queen Mary, intituled, An A&t for Mary, c. 20. granting to Their Majeflies feveral Rates and Duties upon Tonnage of Ships and Veffels, and upon Beer, Ale, and other Liquors; and for fecuring certain Recompences and Advantages in the faid At mentioned, to fuch Perfons as fhall voluntarily advance the Sum of One Million five hundred thoufand Pounds towards carrying on the War against France, or in any fubfequent Act, to the contrary thereof in any wife notwithstanding. XLIV. And it is hereby enacted, That the faid Commiffioners of the Tre fury fhall, and they are hereby refpectively authorized and empowered, to caufe fuch Bills as fhall be prepared by virtue of this Act, to be placed as fo much Cafh in the refpective Offices of the Tellers of the faid Receipt of Exchequer, each and every of which Teller fhall be feverally charged with a Proportion of the faid Bila which fhall be fo placed in his Office refpectively; any Law or Ufage to the contrary nothwithstanding.

XLV. And it is hereby alfo enacted and declared, That the faid Exchequer Bills in the Hands of the faid Teilers fhall be locked and fecured as Cafh, according to the Courfe of the Exchequer, and fhall be taken and efteemed as fo much in part of the Remains, in Real Money, wherewith each of the faid Tellers fhall from Time to Time ftand charged, in common with other the Monies in the faid Exchequer, any Law or Ufage to the contrary notwithftanding.

XLVI. Provided always, and be it further enacted, That the Said Exchequer Exchequer Bills to be made forth by virtue of this Act, together with Bills and Interest the Intereft that may become due thereon, and the Caarges of exchang- charged on ing and circulating the fame, fhall be, and the fame are hereby made Duties granted chargeable and charged upon the Rates, Duties, and Affeffments, granted by this A&t; and it fhall be lawful for the Commiffioners of the Treafury, and they are hereby authorized, from Time to Time, to direct to be iffued to the faid Paymafters, by way of Impreft, and upon account, fuch Sums of Money, and at fuch Periods, as the faid Manner of Commiffioners hall think neceffary, for or towards paying off and reving off faid difcharging the Exchequer Bills which fhall have been made forth by Bills. virtue of this Act, or any of them, and for and towards paying the Intereft to become due on the faid Bills, and for and towards the Charge of exchanging and circulating the fame Bills, or any of them. XLVII. And be it further enacted by the Authority aforefaid, Account of faid That on the Twenty-fifth Day of March One thoufand eight hundred Exchequer Bills and ten, or within Ten Days after, the Commiffioners of the Treasury, or any Three or more of them now being, or the High Treasurer, or 1810. any Three or more of the Commiffioners of the Treafury for the Time being, fhall caufe a true and perfect Account in Writing, to be taken and attefted by the proper Officers, of the Amount of all Exchequer

A.D. 1809. Bills that fhall have been issued by virtue of this A&t, and how much thereof fhall before that Time have been paid off or discharged, and how much thereof fhall then remain undifcharged.

XLVIII. And it is hereby enacted and declared by the Authority aforefaid, That the Monies fo remaining unfatisfied or not difcharged, with the Intereft due or to grow due thereon, and the Charges of exchanging and circulating the fame, fhail be paid and satisfied out of the next Aid or Aids to be granted in Parliament, after the faid Twenty-fifth Day of March One thousand eight hundred and ten.

XLIX. And be it further enacted, That the Surplus of the Monies ariling from the Rates, Duties, and Affeffments, granted and impofed by this A&t, after paying off and fatisfying all the Exchequer Bilis iffued by virtue of this Act, together with the Intereit that may become due thereon, and the Charges of exchanging and circulating the fame, fhall, as the Surplus of any fuch Monies refpectively fhall be paid into the Receipt of the Exchequer, be carried to and made Part of the Confolidated Fund.

L. Provided alfo, and it is hereby enacted by the Authority aforefaid, That the faid Commiffioners of His Majefty's Treasury, or any Three or more of them now being, or the High Treasurer, or any Three. or more of the Commiffioners of the Treafury for the Time being, fhall have Power, and he or they are hereby enabled to pay and allow or caufe to be paid and allowed out of the Monies to arife of or for the faid Rates and Duties hereby granted, or of or for the Confolidated Fund, from Time to Time, the neceffary Charges of making forth the new Exchequer Bills hereby authorized to be made forth, and fuch other Charges as fhall be neceffarily incident, in or for the Execution of this Act, or any Part thereof in relation to the faid Bills, any Thing herein contained to the contrary notwithstanding.

LI. Provided always, and be it enacted by the Authority aforefaid, That whatever Monies fhall be iffued out of the faid Confolidated Fund, fhall from Time to Time be re-placed by and out of the First Supplies to be then after granted in Parliament, any Thing herein contained to the contrary notwithflanding.

CA P. IV.

An Act to allow a certain Proportion of the Militia of Great Britain to enlift voluntarily into the Regular Forces.

[13th March 1809.]

WHEREAS it is neceffary that the most eff&tual Measures

fhould be taken for augmenting His Majefty's Regular Forces; and it is therefore expedient to allow to many of the Militia of Great Britain as will leave ferving, including Corporais, Three-fifths of the Number of the Establishment in Rank and File of each Regiment of Militia, to enlift into His Majefty's Regular Forces, under certain • Provifions and Restrictions; and to enable His Majesty to accept the Services of the Men fo voluntarily enlifting: May it therefore please Your Majefty that it may be enacted,' &c.

"His Majefty may appoint Regiments of the Regular Forces into "which Militia Men may enlift. § 1. Number of Men to be enlifted "fhall not exceed fuch Number as will leave ferving Three-fifths "of the Eftablishment. § 2. Where the Number of Men in any "Regiment exceeding Three-fifths of the prefent Etablishment fhall "be less than Two-fifths of the Eftablishment in 1807; fuch Two. "fifths may enlift. § 3. Commanding Officer fhall afcertain Numbers

willing to enlift, and if it be Five-fixths of the Number allowed, "no more fhall be enlifted without Confent of the Commanding "Officer. § 4. His Majefty may appoint Officers to approve or reject "Men; but none fhall be rejected who are Five Feet Four Inches "(except for Marines), and under Thirty-five Years of Age, unless "difabled. 5. Men enlifted into the Regulars may be transferred "to the Marines. § 6. Commanding Officer of every Regiment, out "of which the Proportion of Five-fixths fhall not enlift within the "first Thirty Days, fhall read His Majefty's Order, and explain the "Terms of Enrolment, &c. 7. If the Number who fhall then "enlift fhall not be the due Proportion, a further Enliftment may "take place for Seven Days. 8. After faid Seven Days, no further "enlifting (unlefs with Confent of Commanding Officer) for One "Month; then Three Days more enlifting, and again, after One "Month more, and afterwards for Three Periods of Three Days each, "at Intervals of Three Months. None fhall be allowed to enlift after "the Expiration of the laft Period. § 9. (But fee 49 G. 3. c. 53. § 32.) "As foon as the Number to be enlilted from any Regiment is afcer"tained, they fhil be difcharged, and if approved, attefted. § 10. "Lieutenants of Counties fhall tranfmit to the Frivy Council the "Number of Men difcharged, &c. § 11. No Perfon in Confinement, "or having been punished under Sentence of a Court-martial within "Three Months preceding, fhall be entitled to culift without Confent "of Commanding Officer, &c. § 12. Clerks, Drummers, Muficians, "Armourers, ad Artillery Men, fhall not enlift without Confent of "the Commanding Officer. § 13 One Serjeant and One Corporal may enlift for every Twenty Men, with Confent of Commanding "Officer. 14. Commanding Officers may retufe to discharge Men "upon Caufe affigned to the Commander of the Diftria, &c. § 15. Perfons difcharged refufing to enlift, or not approved of, fhali continue to belong to the Regiment from which difcharged. § 16. A&t fhall not authorize enlifting or perfuading to enlitt any Militia Man not C 3 " duly
