faid: Provided always, that an Affidavit of the Printer stating his Charge to be ufual and reasonable, be firft laid before the Grand Juries, and that no fuch Prefentment for the printing of fuch Copies fhall be made, unless they are ready for Delivery at the Secretary's Office Three clear Days before each Affizes as aforefaid.

XXIX. And be it further enacted, That the Clerk of the Crown Prefentments for every County, County of a City, and County of a Town in Ire- and Quere Book fhall be printed land, fhall within Twenty-one Days after every Affizes or Prefenting after each Term, deliver to the Treasurer of fuch County, County of a City, or Aflizes. County of a Town (in addition to the Copies of the Prefentments which he is by the faid recited A&t of the Thirty-fixth Year aforefaid required to deliver) an accurate Copy, figned by himself, of the Queries which remained unaccounted for at fuch Affizes; and fuch Treasurer or Grand Jury Secretary, or Chief Clerk, as the Grand Jury fhall think fit, fhall forthwith after the Receipt thereof, cause a Number of Copies of fuch Prefentments and fuch Quere Book to be printed and diftributed to the Magiftrates and principal Overseers, not exceeding Twenty-five for each Barony or Half Barony, and not exceeding Twenty-five for each County of a City or County of a Town; and the Grand Juries of fuch Counties, Counties of Cities, and Counties of Towns, fhall at the Affizes or Prefenting Term next following, prefent to be levied off the County, County of a City, or County of a Town, fuch Sum as fhall be neceffary tor defraying the Expence of printing and diftributing fuch Copies: Provided always, that an Affidavit of the Printer, ftating his Charge to be usual and reasonable, be first laid before fuch Grand Jury; and that no fuch Prefentment for the printing and diftributing of fuch Copies as aforefaid fhail be made unless the printed Copies of fuch preceding Prefentments and Queries fhall have been printed and diftributed within Six Weeks atter fuch preceding Affizes or Prefenting Term.

XXX. And, for the Safety and Convenience of Paffengers and Travellers upon the Publick and other Roads, and in the Streets of Towns in Ireland,' Be it enacted, That from and after the First Day of January in the Year One thoufand eight hundred and ten, all Drivers of Waggons, Carts, Cars, Coaches, Chariots, Curricles, Gigs, Chairs, and of every Kind and Species of Carriages, and all Perfons riding on Horseback, or driving any Animals, either with or without Burdens, on any Road, or in the Street of any City or Town in Ireland, fhall be obliged and they are hereby required to keep their Left Hand Side of the Road or Street in going and coming or fpecified. travelling thereon, and fhall leave the other Side free to all other Drivers of fuch Carriages or Animals, or fuch Travellers; and all Drivers of Carriages or Animals, and Travellers of every Defeription, who fhall have Occasion to pafs by the Drivers of other Carriages or Animals, or Travellers of any Defcription, going in the fame Direction, fhall in all Cafes where it is practicable, take and go on the Right Hand of the Driver or Traveller by whom they shall so have Occafion to pass; and if any Perfon fhall wilfully refufe or neglect to drive and pass in Offender may be Manner and according to the Regulations aforefaid, it shall and may apprehended and be lawful for any Magiftrate, Conftable, Confervator, or Turnpike. thall forfeit 10s. keeper to ftop and detain fuch Offender, and the Carriage and Horfe &c. or Horfes or other Beast on or with which such Offender shall be, and forthwith to carry or convey fuch Offender before any Juftice of the Peace for the County, County of a City, or County of a Town where

A.D. 1809. fuch Offence fhall be committed, or for any Perfon whatsoever to lodge an Information against fuch Offender before fuch Magiftrate, and upon his being convicted thereof upon the Oath of One credible Witnefs, every fuch Perfon so offending fhall forfeit and pay any Sum not exceeding Ten Shillings, to be levied by Diftrefs and Sale of the Goods and Chattels of fuch Offender, or by Diftrefs and Sale of the Carriage or Horfe or Horfes or other Bcafts, and the Goods therein or thereon wherewith fuch Offender fhall have been travelling at the Time of fuch Offence, fuch Diftrefs to be made by Warrant under the Hand and Seal of fuch Juftice, rendering the Óverplus (if any) after de ducting the faid Fine and the Expences of fuch Diftrefs and Sale to the Owners or Owner on Demand; One Half of the Amount of the Penalties fo levied to be paid to the Informer, and the remaining Half to the Minifter or Curate of the Parish in which fuch Offence fhail be committed for the Ufe of the Poor of fuch Parifh; and if Diftress fafficient for fuch Penalty or Penalties fhall not have been seized or found, it shail and may be lawful for fuch Juftice, and he is hereby empowered and required to commit fuch Offender fa convicted to the Common Gaol, without Bail or Mainprize, for any Time not exceeding One Calendar Month, unlefs fuch Offender fhall fooner pay and fatisfy the faid Penalty or Penalties; and every Perfon offending as aforefaid fhall likewife be liable to pay and fatisfy all Damages which fhall happen in confequence of any fuch Neglect or Default as aforefaid.

XXXI. And, for the procuring Returns to be made annually to • Parliament of all Prefentments made by Grand Jurics in Irelandl Be it enacted, That the Treasurer of every County, County of a City, and County of a Town or Place in Ireland, fhall on or before the Twenty-fifth Day of December in each and every Year, caufe a true Copy, figned by himself, of all Prefentments which fhall have been made by the Grand Jury, and fiated by the Court at any Affizes or Prefenting Term in fuch Year on the County, County of a City or Town or Place whereof he is Treasurer, to be forwarded to the proper Officer in His Majelly's Caftle of Dublin, to be from thence tranfmitted fo foon as may be to be laid before Parliament; and in cafe any Treafurer of any County, County of a City, or a Town or Piace in Ireland, fhall neglect to make fuch Return as aforefaid, he fhall forfeit his Office, and be for ever after incapable of acting as Treasurer of any Courty, County of a City, or County of a Town or Place in Ireland, XXXII. And be it further enacted, That nothing in this Act fhail extend or be conftrued to extend to the County of Dublin; except fo far as relates to the obliging of Trustees, Overfeers, Commiffioners or Directors of Turnpike Roads to erect Mile Stones, Mile Potts and Finger Pofts, and except fo far as relates to the Treasurer making Re. turns to Parliament annually of all Prefentments made and fiated by the Court; any Thing in the faid A&t contained to the contrary notwithstanding.

XXXIII. And be it further enacted, That all the Powers, Provifions. Rules and Regulations of the said recited Act of the Thirtyfixth Year aforefaid, shall be extended to this prefent Act; and that this Act and the faid recited Act, fo far as the faid recited Act is not repealed or altered by this Act, or by any other A&t or Acts in force in Ireland, fhall be conftrued together as one Act, to all intents and Purposes.

XXXIV. And be it further enacted, That this A&t fhall take Effect from and after the First Day of January in the Year One thousand eight hundred and ten, and not at any earlier Period; any Thing in the faid Act contained to the contrary notwithstanding.

An Act to make Provision, in certain Cafes, for the Wives and
Families of ballotted Men, Substitutes, and Volunteers, serv-
ing in the Militia of Ireland.
[10th June 1809.]
WHEREAS it is expedient to make fome Provision for the

Commencement of the Acte

as to Acts done

under them.

Families of Serjeants, Corporals, Drummers, and Privates ferving in the Militia of Ireland, when called out into actual Service and the Laws at prefent in force are infufficient for the Purpose;" Be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament assembled, and by the Authority of the fame, That from and after the Commencement of this prefent Act, an Act made in the Forty-third Year of His prefent 43 G. 3. c. 142. Majefty's Reign, intituled, An Act to make Provifion in certain Cafes 44 G. 3. c. 34. for the Wives and Families of Militia Men, Subflitutes, and Volunteers, repealed, except ferving in the Militia of Ireland; and alfo an A&t made in the Fortyfourth Year of His prefent Majefty's Reign, to amend the faid recited Act of the Forty-third Year, fhall be and the fame are hereby repealed, fave fo far as the fame or either of them repeal or repeals any former Act of Parliament, or any Charge, Matter, or Thing therein; and alfo fave as to the Payment and Allowance on account of any Sum or Sums of Money which fhall have become due before the faid Time under or by virtue of the said Acts or either of them, and the obtain. ing the proper and neceffary Voucher for receiving or vouching any fuch Payment; and also fave as to any Offence which fhall or may before that Time have been committed against the faid Acts or either of them, and any Proceeding to be taken for the Punishment of the Of fender or Offenders, or the recovering or levying any Penalty for or by reafon of any fuch Offence; and alfo fave as to any Allowance to any Father, Mother, Brothers, or Sifters of any Militia Man who fhall be ferving in the faid Militia at the Time of the paffing of this Act, and which Allowance fhall continue to be paid under the Provifions of the faid recited Acts; and alfo fave as herein-after mentioned.

II. And be it further enacted, That whenever the Militia of any County, City, or Place in Ireland, fhall be embodied and called out

into actual Service, and any Man ferving or enrolled therein as a Sermarched out of jeant, Corporal, or Drummer, or as a ballotted Man, Substitute, or Volunteer, fhall have left a Family lefs able in confequence of his Abfence to support themselves, and the Colonel or other Commanding Officer fhall give a Certificate in Writing in the Manner and Form herein-after contained and fet forth, which fhall be counterfigned by the Adjutant of fuch Regiment or Battalion, then and in fuch Cafe every fuch Militia Man's Family, the Requifites herein-after men tioned being firft duly performed, fhall be entitled to and shall receive during his Abfence on actual Service the Weekly Allowance following, (that is to fay), after the Rate of One Shilling for every Child born in Wedlock, and under the Age of Ten Years, not exceeding the Numbers herein-after mentioned refpe&tively; and of Two Shillings for the Wife of fuch Man, if he fhall be a ballotted Man; and of One Shilling for the Wife of any fuch Man who fhall not be a ballotted Man; the faid Allowance to the Wife in either of the faid Cafes to be paid whether fuch Man fhall or fhall not have any Child or Children, provided he does not follow the Regiment; and the Form of the aforefaid Certificate fhall be as follows:

III. Provided always, and be it enacted, That the Wife of any Militia Man fo ordered on actual Service fhall not be entitled to the aforefaid Weekly Allowance of One Shilling for each Child, for more than Two Children; and in cafe there fhall be no Wife of fuch Militia Man living, the Weekly Allowance to the Children of fuch Militia Man fhall not exceed the Sum of Four Shillings in the Whole.

IV. Provided also, and be it further enacted, That no Allowance under this Act shall be given or ordered to be given to the Family of Substitute or Volunteer who fhall have married after the Time of bis being called out into actual Service, unless fuch Marriage fhall have taken place with the Confent of the Colonel or Commanding Officer of the Regiment, Battalion, or Corps to which fuch Man fhall belong, and that fuch Confent fhall have been certified under the Hand of fuch Colonel or other Commanding Officer, and no fuch Certificate as aforefaid fhall be granted to any fuch Subftitute or Volunteer who fhall have fo married while on actual Service without fuch Confent first had and obtained as aforefaid.

V. And be it further enacted, That it fhall and may be lawful for any Two Juftices of the Peace acting in and for the Barony or Half Barony, Town, City, or Place in which the faid Family fhall refide, on the Production of any fuch Certificate, to inquire into the Circum ftances of the Family of the Militia Man to whom fuch Certificate fhall

have been granted, whether they refide in the Parish or Place mentioned in the Declaration of fuch Militia Man; and if on fuch Inquiry they fhall find that fuch Family do fo refide, and if fuch Juftices fhall be of Opinion that fuch Family is lefs able to support itself in confequence of the Abfence of fuch Militia Man, they fhall then indorfe fuch their Opinion in Writing under their Hands, on the Back of the faid Certificate, with the Date of the Month and Year, and fhail fubjoin thereto an Order, requiring that the feveral Allowances herein mentioned, after the Rate aforefaid, fhall be paid to fuch Family, fpecifying in fuch Order the Names and Ages of each Perfon of the faid Family entitled to receive the fame; and fuch Certificates, with the Opinions and Orders of fuch Juftices thereon, shall be forthwith depofited by the Perfon or Perfons feeking Benefit thereby, or fome of them, or fome Perfon or Perfons on their, his, or her Behalf, with the Collector of the publick Cefs in fuch Barony or Half Barony, or the Treasurer of fuch City or Town.

VI. And be it further enacted, That at the Expiration of Three Calendar Months next after the Date of any fuch Order of fuch Juf. tices, Application fhall be made by fuch Baronial Collector or TreaSurer to the Juftices who fhall have made fuch Order, or to any other Two Juttices of the Peace acting in and for fuch Barony or Half Barony; and on Production of the original Certificate aforefaid, and of the Order fo first made thereon, it fhall be lawful for fuch Juftices to make a fresh Inquiry into the Circumftances of such Family; and if fuch Circumstances are not altered, fuch Juftices fhall on the Back of fuch original Certificate, and at the Foot of fuch First Order, fign their Names in Affirmance and Renewal of the fame, with the Date of the Month and Year; or if it shall be made appear to fuch Juftices that the Circumftances of fuch Family are any Way altered, fuch Juftices fhall make a new Order for fuch Allowance as aforefaid, fpecifying the Names and Ages of each Perfon of fuch Family entitled to the fame at the Time of fuch Order; and fo after the Expiration of every Three Calendar Months a like Inquiry and Order fhall, from Time to Time. be made and renewed or altered by Two Justices of fuch Barony or Half Barony, fo long as any fuch Allowance fhall be made on Behalf of fuch Family. VII. And be it further enacted, That every fuch Baronial Collector or Treasurer fhall, from Time to Time, within Three Days after fuch Order or Orders fhall be made by fuch Juftices, prepare and fign an Abtract of every fuch Order, and fhall forthwith deliver or fend fuch Abstract duly dated by him to the Collector of Flis Majefty's Excife for the District in which fuch Barony, Half Barony, Town, or City fhall be fituate, together with every fuch Certificate and Order thereupon; and fuch Collector of Excife having compared fuch Ab. ftract with fuch Order fhall, if the fame fhall agree therewith, counterfign every fuch Order, and forthwith reftore the fame to fuch Baronial Collector or Treasurer, or to the Perfon by whom the fame was fent, and fhall then counterfign and file such Abstract, and fhall keep the fame as a Voucher for his future Payments in Manner herein-after mentioned.
