of any County, County of a City, or Town, fübject to the like Affidavit and Regulations prefcribed by the aforefaid Act of the Thirtyfixth of His prefent Majefty.

X. And be it further enacted, That it fhall and may be lawful for any Grand Jury, in Cafes where the Battlements of Bridges fhall have been lately built or repaired by Prefentment, to contract for keeping the fame in Repair for any Term not lefs than Seven Years; provided that no larger Sum than One Shiling fhall be paid annually for every Perch in Length of fuch Battlement; and provided that no Money fhall be paid, unless it fhall appear to the Grand Jury, by the Affidavit of the Contractor, and the Certificate of the Confervator the Road in the Barony in which the Bridge is fituate, or of a Magiftrate, that the faid Battlements are and have been kept in good and fufficient Repair fince the Affiz:s preceding.

XI. And be it further enacted, That it fhail and may be lawful for any Grand Jury of a County, County of a City, or County of a Town, in fuch Cafes where they may deem it advise able to prefent for the paving of a Road or Street by the fquare Yard, inftead of making or repairing the fame by the Perch, with Gravel or fmall Stones: Provided always, that all and every Sum and Sums of Money fo to be prefented fhail be fo prefented, and all Payments on account of fuch Prefentments fhall be made on the like Affidavits, and sub. jet to like Regulations and Conditions as are prefcribed and required with refpect to the prefenting and paying Money for the like Purposes by the aforefaid A&t of the Thirty fixth of His prefent Majetty, except fo far as the fame may require to be altered in order to make them conformable to the Provifions of faid A&.

XII. And be it further enacted, That which Affidavit every any Prefentment for any Pipe, Gullet, or Sewer, fhall be granted, fhall fpecify the Dimenfions of fuch Pipe, Gullet, or Sewer.

XIII. And be it further enacted, That from and after the paffing of this A&t, in lieu of the Sum which Grand Juries are allowed to prefent for Mile Stones and Finger Pofts by the faid recited Act of the Thirty fixth Year aforefaid, it fhall and may be lawful for the Grand Jury to prefent, to be raised off the County at large for cach and every Direction Poft, Mile Stone, or Mile Poit, any Sum or Sums of Money not exceeding Twenty Shillings for each Mile Stone or Mile Poft, and not exceeding Thirty Shillings for each Finger Poft: Provided always, that an Estimate upon Oath be previously laid before fuch Grand Jury, ftating the Expence of procuring and erecting fuch Mile Stones or Mile Pofts or Finger Polls, ftating the Dimentions thereof, and the Size of the Letters and Figures to be infcribed thereon respectively.

XIV. And be it further enacted, That the Trustees, Overseers, Commiffioners, or Directors for the Time being of the feveral Turn pike Roads in Ireland, fhail and they are hereby required to erect or caufe to be erected upon and throughout the Lines of the respective Roads under the Care and Management of fuch Trustees refpectively, within Two Years after the paffing of this Act, proper and fufficient Mile Stones or Mile Pofts at exact and due Distances from cach other, on each of which fhall be legibly infcribed the Number of Miles fuch Mile Stone or Mile Poft is diftant from the City of Dublin, if the Road leads to or from Dublin direct, and alfo the Num ber of Miles the fame is diftant from fuch Town, on each Side

thereof, on the Line of fuch Road, as they fhall think proper; and alfo to erect or cause to be erected at all Publick Crofs Roads which occur in the Line of any fuch Road, proper and fufficient Finger Pofts, on each Side of which shall be legibly inferibed the Number of Miles fuch Finger Poft is diftant from any Town or Village to which fuch Finger Polt fhall point or direct; and in cafe the Truflees, In default of Commiffioners, or Directors of any Turnpike Road shall neglect to Trustees, Grand erect proper and fufficient Mile Stones and Finger Pofts in and Juries fhall throughout the refpective Lines of their Roads within the Term of prefent. Two Years aforefaid, then and in fuch Cafe it fhall be lawful for the Grand Jury of any County, County of a City, or County of a Town wherein any fuch Neglect fhall take place, at any Affizes or Prefenting Term after the Expiration of the said Two Years, to prefent fuch Sum or Sums as may be neceffary for procuring and erecting fuch Mile Stones or Mile Pofts and Finger Pofts, not exceeding Twenty Shillings for each Mile Stone or Mile Poft, and Thirty Shillings for each Finger Poft; and it fhall and may be lawful for the Treasurer of fuch County, County of a City, or County of a Town in which the Grand Jury fhall have caufed Mile Stones or Mile Pofts and Finger Pofts to be procured and erected as aforefaid, to fue the Trustees of the Turnpike Road on which the fame fhall have been erected, by One or more Civil Bill or Bills (in which Suit either the Treasurer or Secretary to the Trustees of fuch Roads shall be made the Defendants) and to recover from them the full Amount Amount fhall of the Sum fo expended by order of the faid Grand Jury in erecting be recovered Mile Stones and Finger Pofts as aforefaid, together with the Cofts of by Trustees by Suits, and alfo a Sum of Two Shillings in the Pound upon the Civil Bill. XV. And be it further enacted, That on every Presentment for No Prefentment the raifing of any Publick Money whatfoever, which fhall be made fhall be allowed by any Grand Jury appointed by the Court at any Affizes or Pre- in future which fenting Term, for any County, County of a City, or Town in does not flate Ireland, the Title of the particular Act of Parliament under which it the Law from fuch Prefentment fhall be made and fiated, fhall be ftated on the which Grand Face of fuch Prefentment; and that every fuch Prefentment fha Juries derive be entered in the County Book, and Quere Book, with a Marginal their Authority. Note of fuch Act, fpecifying the Year of the King's Reign, and the Chapter and Section of fuch Act as printed by the King's Printer; and that all Prefentments not made according to the Directions foregoing fhall be null and void.

XVI. Provided nevertheless, and be it further enacted, That the foregoing Regulation fhall not extend or be conftrued to extend to to Roads, any Prefentment for forming, levelling, fencing, draining, widening, Bridges, Seffion making, repairing, or otherwife improving any Road, or to the build. Houfes, &e. ing, repairing, or otherwife improving any Bridge, Seffions House, Gaol, or other Mafon Work.

XVII. And whereas Doubts have arisen whether the Words contamed in Affidavits accounting for the Repairs of Roads, ftating that Part of the Width of fuch Roads is made with Gravel or small Stones, do not imply that in every Perch to be repaired the whole Width has been toned or gravelled anew;' Be it further enacted, That the Repairs of Roads may be eftimated, prefented, and ac- Affidavite as to counted for, without fpecifying any particular Breadth in each Perch gravelling Roads

XVIII. And be it further enacted, that from and after the End of the feveral Lent Affizes which fhall be held in Ireland in the Year Repairs of Road, One thoufand eight hundred and ten, no Affidavit for the accounting Backs of Ditches for the Repairs of any Road fhall be allowed by the Grand Jury, or by the Court at any Affizes or Prefenting Term in or for any County, or County of a City or Town in Ireland, unless it fhall be fpecially ftated in fuch Affidavit that there is not on either Side of any Part of the Road fpecified in fuch Affidavit, any Grip, Trench, or Drain, without a Wall or other fufficient Fence between fuch Grip, Trench, or Drain, and the Side of fuch Road.

XIX. And be it further enacted, That it fhall and may be lawful for any Grand Jury of a County, County of a City, or County of a Town, at any Affizes or Prefenting Term, to prefent any Sum that may be neceflary for filling up Grips on the Sidea of Road, provided an Affidavit be firft laid before them, ftating the Length, Breadth, and Depth of fuch Grips propofed to be filled up, and that the Sum is a reafonable Charge; and provided alfo, that no Money on account of fuch Prefentment fhall be paid until an Affidavit is firft laid before the Grand Jury, ftating that the Money has been fairly and honeftly expended according to fuch Prefentment, with the Particulars of the Expenditure.

XX. And be it further enacted, That whenever and as often as any Sum, by way of Compenfation for Damage, is awarded (under the Provifions of the faid recited A&t) to any Owner or Occupier of Land from whence any Gravel, Stones, Sand, or other Materials have been taken by any Overfeer for filling up Grips, as well as for the other Purposes therein specified, it fhall and may be lawful for the Grand Jury to prefent the fame, to be levied off the Barony or Half Barony, County of a City, or County of a Town in which the Ma terials have been expended, provided it fhall appear to them that the Appraisers have viewed the Land both before and after the Damage has been committed, and that all the Stipulations contained in the faid A&t for the like Purposes have been duly complied with and performed. XXI. And be it further enacted, That no Words in any accounte ing Affidavit, required by the faid recited A&t of the Thirty-fixth Year, or this Act, importing that the Account annexed to fuch Affidavit is true in every Part, fhall extend or be construed to extend to prevent the paffing of the Accounts for any Road which shall have been or fhall be repaired by Contract: Provided always, that the Time of fuch Contract fhall be fpecified in fuch Account, and that it shall be flated in fuch Affidavit that the faid Contract was fairly made and entered into, upon the best and most advantageous Terms that could be procured, without Favour or Partiality to the Contractor, and that fuch Contractor has given Security to the Overfeer for keeping the Road in repair for One Year from the Date thereof.

XXII. And be it further enacted, That no Affidavit for the ac counting for the Expenditure of any publick Money for any Road, or for any publick Work, fhall be allowed by the Grand Jury, or by the Court at any Affizes or Prefenting Term or October Seffion, in any County, County of a City or Town in Ireland, unless it fhall be ftated in fuch Affidavit that the Road or Work therein men. tioned was completed on fome Day, being not less than Six clear

XXIII. And whereas in the aforefaid A&t of the Thirty fixth of His prefent Majefty, it is enacted, That in every Warrant to be iffued by the Treasurer of the County to the feveral Perfons who, under the Provifions of the faid A&, are to be the Collectors for levying or collecting the Sums of Money to be railed off each Barony or Half Barony, there fhall be inferted the Names of the • several Manors. Parishes, or Denomu ations contained in that Por ⚫tion of the County which fuch Perfon is to collect from, as the fame is contained in the County Book, and alío the whole Sum to be ollected, and the Portion thereof which each Manor, Parish, or • Denomination is to pay, according to its Contents in the County Book, or as it has been ufually rated at: And whereas there are fome Counties which either have no County Book, or in which Book no Manors, Parishes, or Denominations are inferted, or in f which the Contents of all or fome of the Manors, Parishes, or Denominations are not specified, and no ufual or regular Rate has pre vailed, fo as to give official Knowledge to the Treasurer, and enable him to infert, agreeable thereto, the Portion which each • Manor, Parish, or Denomination is to pay;' Be it therefore enacted, That in all or any of fuch Counties, it fhall be lawful for the Grand Grand Juries Jury, at the next Affizes after the paffing of this Act, or at any fhall form Table fubfequent Affizes, to form a Table of the Names of the feveral of the Names Parishes, Manors, and Denominations, and the Contents of each in of fuch Tariflies, any Barony or Half Barony, the Manors, Parishes, and Denomination &c. and the whereof, with their Contents, are not contained in the County Book, and the Treasurer of fuch County fhall cause publick Notice to he given thereof throughout fuch Barony or Half Barony, by ordering County Book. the Collector, High Conftable, or Sub-Conftable. to poft a Copy of fuch Table on the Door of each Church within fuch Barony or Half Barony, and on the Door of every Market House therein, Thirty Days at the leaft previous to the then next ensuing Affizes, requiring all Perfons who may think themselves aggrieved by tuch Table to appear before the Grand Jury at such then next enfuing Affizes, and fuch Grand Jury at fuch Affizes fhall proceed, if they shall think proper, to examine fuch Perfons as fhall fo appear upon Oath, (which Oath fuch Grand Jury is hereby empowered to adminifter,) refpecting fuch Table, and any Objections thereto, and it fhall be lawful for fuch Grand Jury, at fuch lait mentioned Affizes, to amend fuch Table as they shall think fit, and to prefent fuch Table, either as originally formed or amended as aforefaid, to be the Table by which the feveral Manors, Parishes, and Denominations in fuch Barony or Half Barony, fhall in future be proportionably rated for the Purpose of levying all Money to be raised thereon under Prefentment of Grand Juries, and the Names of fuch Manors, Parishes, and Denominations, with the Contents of each, fhall be inferted in every Warrant to be issued thereafter by every Treasurer of any fuch County to any Collector as aforefaid, in like Manner as if the fame had been contained in

XXIV. And be it further enacted, That no High Constable or Collector fhall be authorized to collect any Prefentment, Cefs or pub. lick Money, unlefs the Security required by the faid recited Act of the Thirty-fixth Year, to be given by him, fhall be duly entered into before the Grand Jury by whom fuch High Conftable or Collector fhall have been appointed, by Bond and Warrant of Attorney, with out Stamp, conditioned as in the faid recited Act is specified and fet forth; any Thing in the faid recited Act to the contrary notwithftanding.

XXV. And be it further enacted, That no Prefentment for Pound. age fhail be made for collecting any publick Money by any Grand Jury, or fiated by the Court, under the Provifions of the faid recited Act of the Thirty-fixth Year aforefaid, unless the Treafurer's Warrant under which fuch Collector has proceeded to levy the Cefs be annexed to fuch Prefentment, nor unlefs fuch Collector and his Deputies fhall make Affidavit before the faid Grand Jury that such has been fairly and impartially levied, and that no more than the Sum authorized by the Treasurer's Warrant, with the customary Collector's Fees, has been collected, to the best of his and their Knowledge and Belief.

XXVI. And be it further enacted, That no Prefentment for any Salary, Poundage or Allowance, to any Treafurer of any County, County of a City or Town in Ireland, fhall be made by any Grand Jury or fiated by any Court or Judge, unless there shall be previously produced to fuch Judge by the acting Clerk of the Crown at the Affizes or Prefenting Term in which fuch Prefentment shall be required to be made, a Certificate figned by the proper Officer, ftating what Securities for the due Performance of his Office fuch Treasurer has given and entered into, and that fuch Securities have been duly recorded in the proper Office, and fuch Certificate fhall ftate the Dates when fuch Securities were entered into, the Names of the respective Sureties. and the Sums for which fuch Sureties were feverally bound,

XXVII. And be it further enacted, That all Affidavits for Prefentments for forming, levelling, fencing. draining, widening, making, repairing, or otherwife improving any Road, and for the building, repairing, or otherwife improving, any Bridge, Seffion Houfe, Gaol, or other Mafon Work, fhail be lodged Fifteen Days at the leaft before the Commiffion Day of each Affizes, with the acting Secretary of the Grand Jury, who is hereby required to keep an Office open for the Purpose, in the Manner prefcribed by the aforefaid A&t of the Thirtyfixth of His prefent Majefty, and fuch Secretary fhall forthwith after the Receipt thereof, (provided he shall be ordered by the Grand Jury at the previous Affizes fo to do) caufe Copies of the Schedules of fuch Affidavits to be printed and ready for Delivery at his Office, Three clear Days before each Affizes, to fuch Magiftrates and Overfeers of Roads, or other publick Works, as may apply for the fame, provided that the Number fo to be printed fhall not exceed Twentyfive for each Barony or Half Barony, and Twenty-five for each County of a City, or County of a Town,

XXVIII. And be it further enacted, That the Grand Juries of Counties, Counties of Cities, or Counties of Towns, fhall at each Affizes or Prefenting Term, prefent fuch Sum as fhall be neceffary for defraying the printing of the Schedules of the Affidavits as afore
