it is expedient to make fuch Provision as is herein-after mentioned for the Forfeiture of fuch Sa.ted Beef, Fork, or Bacon;' Be it therefore enacted, That the Perfon or Perfons bringing any Salted Beef, Pork, or Bacon, by Laud, from Scotland to England, fhail immediately on the Arrival thereof in England make Entry thereof at the nearest Office of Excife in England, and in Default of making fuch Entry, all fuch Salted Beet, Pork, or Bacon, or the Value thereof, fhail be forfeited.

IV. And whereas by an Act made in the Thirty eighth Year of His prefent Majefty' Reign, intituled An Act for transferring the Management of the Salt Duties to the Commiffioners of Excife, and for repealing the Duties on Salt, and the Drawbacks, Allowances, and Bounties poid thereout. and for granting other Duties. Drawbacks, Allowances, and Bounties thereon, the Proprietor or Proprietors of any export Warehoufe, provided and entered for the Purpose of Jaying, forin, and keeping Salt for Exportation at the Port of Liverpool or Briflol, is and are for any Deficiency found upon the proper Officer of Excife weighing and taking the Account in the Month of June therein directed of the Stock of Salt maining in any fuch Export Warehouse, fubje& and liable to forfeit ard lofe at and after the Rate of Twelve Shillings for every Bufhel ⚫ of Salt fo deficient, One Sixth Part of which is by the fait A& • directed to be to the Officer or Officers who fall difcover fuch Drficiency, and the other Five Parts to and for the Ufe of His M jetty: And whereas the Fifh curer or Fish-curers, whofe Stock of Salt appears to be deficient on weighing and taking Account of and balancing the fame in the Month of May, is by the said A& fubje& ⚫ and liable to forfeit and lofe at and after the Rate of Twelve Shilings for every Buthel of Salt fo deficient, Five-Sixth Parts whereof is by the faid Act directed to be applied to the Ufe of His Majetty, His Heirs and Succeffors, and the remaining Sixth Part thereof to the Ufe of the Officer or Officers of Excife who hail difcover fuch Deficiency: And whereas the faid Sums of Twelve Shillings per Bushel refpectively were Two Shillings per Bufhel above the Rate of Duty to which Silt for Home Trade was liable at the Time of paffing the faid Act, but by the Laws now in force the faid Dury has been raifed to the Rate of Fifteen Shillings per Bufhel, and it is therefore expedient to raise the faid refpective Sums of Twelve Shillings in Manner herein-after mentioned;' B it therefore enacted. That from and after the pafling of this Act, the Proprietor or Proprietors of any fuch Export Warehouse fhall in lieu and inftead of the faid Sum of Twelve Shinings for every Bufhel of Sait deficient in Manner in the faid Act in that Behaif mentioned, forfeit and lofe at and after the Rate of Seventeen Shillings for every Bufhel of fuch Salt which fhall be fo deficient, and that the Fishcurer or Fish-curers whofe Stock of Salt fhall appear to be deficient in Manner in the faid Act in that B-half mentioned fhall, in lieu and inttead of the faid Sum of Twelve Shillings for every Bufhel of Selt deficient, in Manner in the faid A&t in that Behalf mentioned, forfeit and lofe at and after the Rate of Seventeen Shillings for every Bufhel of fuch Salt which fhall be fo deficient: which fard Sums of Money fhall be paid and applied by the Commiffioners of Excife in Manner hereinafter mentioned, that is to fay, Fifteen-Seventeenth Parts

and might be lawful for the Owner, Proprietor, or Shipper of fuch Silt or Rock Salt to make application in Writing for Relief to His Majesty's Juices of the Peace of the County, Riding, Divifion, ⚫or Shire nearelt, to which any fuch Accident fhould happen at the Quarter Seffions of the Peace, or to the Commiffioners of the Excife at the Chief Office of Excife in London, or any Three of the faid • Commiffioners, and thereupon it fhould and might be lawful to and ⚫ for fuch Jutic-s of the Peace at the Quarter Seffions or Commiffioners of Excile, or any Three of fuch Commiffioners refpectively, to receive and admit fuch Application, and to examine all Parties touching the Matter contained therein, and upon due Proof of the Fact by Two or more Credible Witneffes, one of whom fhould be the Mater or Mate of fuch Fiat, Boat, Barge, or Veffel, if fuch Matter or Mate be living at the Time fuch Juftice or Commiffioners refpectively are thereby authorized and required

made in the Thirty-eighth Year of the Reign of His prefent Majefty for transferring the Management of the Salt Duties to the • Commiffioners of Excife, the faid Commiffioners of Excife at the Chief Office of Excife in London, or any Three of them, are • authorized to grant Relief in Manner therein mentioned with refpe&t to Salt or Rock Sit loft by Capture of Enemies: And whereas it is expedient to reftrict the Jurifdiction of the faid Commiffioners of Excife at the Chief Office of Excife in London to fuch Salt only as thall be loit or destroyed on the Coats of that Part of Great Britain called England and in Rivers or Inland Navigation thereof;' Be it therefore enacted, That from and after the paffing of this A it fhall not be lawful to or for the Commiffioners of Excife or any of them, to receive or admit any fuch Application, or to grant any Relief for or in refpect of any Salt loft by Capture of Enemies on the Coaft of that Part of Great Britain called Scotland, or loft or destroyed through Strefs of Weather or Storms at Sea, or by the accidental or unavoidable cafting away, finking, or tranding of any Fiat, Boat, Barge or Veffel, on the faid latt mentioned Coaft, or in any River or Inland Navigation in that Part of Great Britain called Scotland; any Thing in the faid lalt mentioned Acts, or either of them, to the contrary in any wife notwithitanding.

VI. And whereas by an Act, made in the Forty-fifth Year of the Reign of His prefent Majelty, intituled, An Ad for granting § 3. refpecting additional Duties on Salt in Great Britain, it is enacted, That in all Drawbacks on Cafes Salt repcaled.

Salt feized and put up to Sale which will not produce the Duty fhall be deftroyed, and the Committion ers fhall reward

Utenfils ufed with Veffels liable to Forfeiture, fhall alfo be forfeited.

Penalties fhall be levied as under Excife Laws.

Cafes where Duties are granted and Drawbacks allowed by that Act on any specific Quantity of Salt, the fame fhould in every Cafe be undertood and deemed and taken to apply in the fame Propor tion and after the fame Rate to any greater or lefs Quantity than fuch specific Quantity: And whereas it is expedient to repeal fo much of the faid recited Claufe, as relates to the faid Drawbacks,' Be it therefore enacted, That fo much of faid recited Claufe, as relates to the faid Drawbacks, fhall be and the fame is hereby repealed.

VII. And whereas Salt feized by the Officers of Excife is fre quently fo foul and dirty that it will not fell for a Sum equal to the Amount of the Duties, and the Sale thereof at a lefs Price would be injurious to the Revenue, and it is therefore expedient to make fuch Provifion as is herein-after mentioned ;' Be it therefore enacted, That if upon the putting up or offering to publick Sale any Salt which now is or hereafter fhall be feized by any Officer or Officers of Excife, and condemned under or by virtue of any Act or Acts of Parliament now in force, or which fhall hereafter be made, no Perfon or Perfons fhall offer or bid for the fame fuch Sum or Sums

of Money as fhall be equal to or exceed the Duties by Law impofed for or in refpect of Salt made at any Salt Work in England or Scotland refpectively, it fhall and may be lawful to and for the Commif fioners of Excife in England and Scotland refpectively, or any Three or more of them refpectively, to caufe fuch Salt to be deftroyed, and to give the Officer or Officers by whom the fame was feized fuch pecuniary Reward as they the said Commiffioners respectively shall think proper, fuch Reward not exceeding Five Shillings per Bufhel for each and every Bushel of fuch Salt fo deftroyed.

VIII. And whereas by feveral Laws of Excife the Veffels made Ufe of in private Manufactories of the Excifeable Commodities therein mentioned are forfeited, but the Forfeiture does not extend to the Utenfils made use of in fuch Manufactories, and it is there⚫fore expedient to make fuch Provision as is herein-after mentioned ;' Be it therefore enacted, That where any Veffels would if fourd be liable to Forfeiture for want of Entry having been made or Notice given thereof, or for being private or concealed, all the Utenfils used or employed, or fit or proper to be ufed or employed, in the Manufacture of any excifcable Commodity in any private or unentered Room or Place where any fuch Veffel fhall be found or have been made Ufe of fhall be forfeited, and all fuch Utenfils fhall and feized by any Officer or Officers of Excise.

IX. And be it further enacted, That all Fines, Penalties, and Forfeitures, impofed by this or any other A&t or Acts of Parliament now in force, or hereafter to be made, relating to the Duties of Excife, fhall and may be fued for, levied recovered, and mitigated, by fuch Ways, Means, and Methods, as any Fine, Penalty, or For feiture is or may be recovered or mitigated by any Law or Laws of Excife (not otherwife fpecially directed by this or any fuch other Act or Acts of Parliament), or by any Action of Debt, Bill, Plaint, or Information, in any of His Majefty's Courts of Record at We minfer, or in the Court of Exchequer in Scotland, and that one Moiety of every fuch Fine, Penalty, or Forfeiture, fhall be to His Majefty, His Heirs and Succeffors, and the other Moiety to him or them who fhall difcover, inform, or fue for the fame.

A&t, pailed in the prefent Seffion of Parliament, intituled, An A& 49 G. 3. c. 48. to amend and render more effectual an Act paffed in the laft Seffion of Par iament, for enabling His Majefly to clablish a permanent Local Militia Force in Scotland, under certain Refriclions, for the Defence of the Realm: And whereas it is expedient that the laid Two recited Acts, paffed in the prefent Seffion of Parliament, should be amended and that further Provisions should be made in relation to the Local • Militia eftablished by the fa'd Two recited Acts paffed in the last • Seffion of Parliament;' Be it therefore enacted by the King's most Excellent Majelty, by and with the Advice and Content of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled and by the Authority of the fame, That no Serjeant or Non-commiffioned Officer, or Drummer, or Musician in the Local Mintia of Great Britain, not being on Permanent Pay as fuch, fhall be required or compelable to farve in the Local Militia for any longer Period of Time than is in the faid Acts of the laft Seffion of Parliament refpeftiv-iv fpecified and required as to Private Men ballotted and enrolled to ferve in the Local Militia, notwithstanding any Oath or Engagement into which any fuch Serjeant, Non-commiffioned Officer, or Drummer, or Mufician fhall have taken or entered into at the Time of his becoming a Serjeant, Non-commiffioned Officer, or Drummer, or Mufician, in the faid Local Militia.

II. And be it further enacted, That it shall not be lawful for any Adjutants, Quarter Matters, or Serjeants, or Non-commiffioned Officers of the Local Militia of Great Britain. to receive or command, or train or exercife any Men enrolled for the Regular Militia of their respective Counties or Stewartries as directed by the faid recited Acts of the prefent Seffion, unless they fhall be ordered and directed fo to do by the Lieutenants, or Vice-Lieutenants, or Deputy-Lieu- c. 40. § 24.] tenants acting for any Lieutenant of any fach County or Stewartry, who are hereby refpectively authorizeed and empowered to make or give any fuch Orders and Directions to fuch Adjutants, QuarterMasters, and Non-commiffioned Officers, as they fhall fee fit in that Behalf.

III. And be it further enacted and declared, That the Provifion in the faid recited A&ts of the prefent Seffion of Parliament contained, as to making Eitates of the Value required by the Laws relating to the Militia, good and valid Qualifications for any Officer of

Militia, although the fame fhall not be fituate in the County or Stewartry to which the Officers having fuch Estates refpectively fhall belong, thall be deemed and conftrued to extend to the Local Militia only, and not to the Regular Militia.

ÍV. And whereas Doubts have arifen as to the Enrolment of the Local Militia of the Stannaries by the Warden of the Stannaries;' for Remedy whereof, be it declared and enacted. That the Enrolment of the Local Militia of the Stannaries by the Warden of the Stannaries, and the adrinittering the Oath to the Perfons enrolled in the Local Militia of the Staunaries, fhall be and be deemed to be as good, valid, and effectual, to all Intents and Purpofes, as if the fame had been done by any fpecial Deputy-Wardens at any Meeting, and the faid Warden of the Stannaries fhall be and is hereby indemnified for and on account of the fame, and releafed and dif charged from all Actions, Suits, Penalties, and Forfeitures whatever incurred by him for any Thing done in relation to fuch Enrolment of the Local Militia of the Stannaries as aforefaid.

V. And whereas the Quota of Local Militia established for the Cinque Ports, Two ancient Towns, and their Members, by the faid recited A&t of the Forty-eighth Year aforefaid, bave been found, by reafon of the Number of Seafaring Men refiding within the faid Cinque Ports, ancient Towns, and Members, to exceed the due Proportion of Etablishment of Loca! Militia according to the Number of Men liable to ferve;' Be it therefore enacted, That it fhall be lawful for His Majesty's Privy Council, and they are hereby empowered, to afcertain, fettle, and fix the Quota of Local Militia for the faid Cinque Ports, Two ancient Towns, and their Members, and for that Parpole to require and have all fuch Returns of the Number of Men liable to ferve and exempt therein, as fhall be neceffary to enable the faid Privy Council to regulate and fix a proper Quota for fuch Local Militia; any Thing in the faid recited A& to the contrary notwithstanding.

An Act for the Amendment of the Laws now in force in
Ireland, relative to Perfons entering into Recognizances in
Criminal Cafes, in Cuftody under any Fine, or under fuch
Recognizance.
[10th June 1809.]

WHEREAS great Neglects have been committed in the iffung

of the Process for levying the Sums due for forfeited Recog nizances in Ireland, and for Fines impofed at Affizes, Commiffions of Oyer and Terminer, and General Gaol Delivery and Seffions of the Peace in Ireland, and in confequence thereof many Recogni zances, which have been forfeited by Perfons bound for the Appear ance or Profecution of Perions charged with Crimes, or for keeping the Peace, have remained for a great Length of Time in Arrear and unpaid, and many Fines impofed at Affizes. Commiffions of Oyer and Terminer, and General Gaol Delivery and Seffions of the Peace, have remained unpaid and uncollected: And whereas it would not be expedient to iffue and enforce the Procefs for levying the Arrears thereof which have been fuffered fo long to remain due;' Be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Tem
