A.D. 1809. them, and Juftice or Juftices of the Peace refpectively, are hereby authorized and empowered to adminifter, fetting forth the Ground of his or their Sufpicion, it fhall and may be lawful to and for the faid Commiffioners of Excife, or any Two or more of them, or the Juftice or Juftices of the Peace refpectively, as the Cafe may require, before whom fuch Oath fhall be made, if they or he thall judge it reasonable, by Special Warrant or Warrants under his and their respective Hands and Seals, to authorize and empower fuch Officer or Officers by Day or by Night, but if in the Night Time in the Prefence of a Constable or other lawful Officer of the Peace, to enter into all and every fuch Place or Places where he or they fhall fo fufpect fuch Spread Window Glafs or Crown Glafs refpectively to be depofited, lodged, hid, or concealed, and to feize and carry away all fuch Spread Window Glafs and Crown Glafs refpectively, which he or they fhall then and there find so depofited, lodged, hid, or concealed, as forfeited; and if any Perfon or Perfons whatsoever shall let, obftruct, or hinder anv fuch Officer or Officers fo authorized and empowered, or any other Person or Perfons acting in his or their Aid or Affiftance in the Execution of fuch Warrant, from entering any fuch Place or Places where fuch Officer or Officers fhall fo fufpect fuch Spread Window Glafs or Crown Glass respectively to be fo depofited, lodged, hid, or concealed, or in feizing or carrying away the fame, or in the due Execution of any fuch Warrant, the Perfon or Perfons fo offending fhall for each and every fuch Offence feverally forfeit the Sum of One hundred Pounds.

XXI. And be it further enacted, That if any Perfon or Perfons fhall obftruct, or hinder any Officer or Officers of Excife in the Execution of any of the Powers or Authorities to him or them given, or granted by this or any other Act or Acts of Parliament relating to Glafs, the Perfon or Perfons fo offending therein, fhall for each and every fuch Offence, other than for those for which any Penalty is herein before specially imposed or provided, severally forfeit the Sum of Three hundred Pounds: Provided always, nevertheless, that nothing in this Act contained fhall extend or be conftrued to extend to make it unlawful to or for any Officer or Officers of Excife, from Time to Time, and at all Times to infpect, examine, gauge, or otherwise to take an Account of the Metal and Materials mixed and prepared or founded, or founding for the making of Glafs in any fuch Glaís House or Building as aforefaid, as well before fuch Metal or Materials fhall be put into any Pot or Pots, as after the fame fhall be put into any Pot or Pots, or to take a Sample or Samples not exceeding Four Ounces in the Whole, out of each fuch Pot or any other Veffel or Utenfil containing fuch Preparation for making Glafs.

XXII. And be it further enacted, That all Fines, Penalties, and Forfeitures fhall Forfeitures by this A&t impofed, fhall be fued for, recovered, levied, or mitigated, by fuch Ways, Means, and Methods, as any Fine, Penalty, or Forfeiture, is or may be fued for, recovered, levied, or mitigated, by any Law or Laws of Excife, or by Action of Debt, Bill, Plaint, or Information in any of His Majetty's Courts of Record at Weflminfler, or in the Court of Exchequer in Scotland, and that one Moiety of every fuch Fine, Penalty, or Forfeiture fhall be to His Majetty, His Heirs and Succeffors, and the other Moiety to him, her, or them who fhall discover, inform, or fue for the fame.

XXIII. And be it further enacted, That all the Powers, Authorities, Acts extended to Methods, Rules, Directions, Regulations, Penalties, Forfeitures, Pro

vifoes, Claufes, Matters, and Things, which in and by an Act or Acts of Parliament relating to the Duties on Glafs, or on the Materials or Metal, or other Preparation made use of in Great Britain, in the making of Glafs, or to the paying or allowing of any Drawback on the Exportation of Glafs, in force immediately before the paffing of this A&t are contained, provided, fettled, or eftablished, for managing, affeffing, raifing, levying, collecting, recovering, adjudging, mitigating, afcertaining, enforcing, and fecuring the faid Duties, or for paying or allowing any Drawback of the faid Duties, and for preventing, detecting, and punishing Frauds relating thereto, except where the fame are exprefsly altered by this Act, fhall be and remain in full Force and Effe&t to all Intents and Purposes, and the faid Powers, Authorities, Methods, Rules, Directions, Regulations, Penalties, Forfeitures, Provifions, Claufes, Matters, and Things, (except as before excepted), fhall continue and be duly obferved, practifed, applied, ufed, and put in Execution, throughout the whole Kingdom of Great Britain, as fully and effectually to all Intents and Purposes (except as before excepted) as if the faid Powers, Authorities, Rules, Directions, Regulations, Penalties, Forfeitures, Provifions, Claufes, Matters, and Things, had been exprefsly inferted and re enacted in this prefent A&t

XXIV. And be it further enacted, That all Monies arifing by the Duties by this A& impofed (the neceffary Charges of raifing and accounting for the fame excepted) fhall from Time to Time be paid into the Receipt of His Majesty's Exchequer at Westminster, and fhall be carried to and made Part of the Confolidated Fund of Great Britain. XXV. · And whereas by an A&t paffed in the Forty-fifth Year of 45 G. 3. c. 30. the Reign of His prefent Majefty, intituled. An Ad for granting unto His Majefly feveral additional Duties of Excife in Great Britain; it is • provided, That the Commiffioners of His Majesty's Treasury, or any • Three or more of them, or the Lord High Treasurer for the Time being, fhall for the Period of Ten Years from the Commencement of the faid Act, caufe a feparate and diftinct Account of the additional Duties by the faid Act granted, to be prepared and annually laid before Parliament, purfuant to an Act paffed in the Forty-fecond Year of the Reign of His prefent Majefty, intituled, An Act for di. 42 G. 3. c. 70. reding certain Publick Accounts to be laid annually before Parliament, and for discontinuing certain other Forms of Account now in Ufe; and whereas One-third Part of the Duties by this A&t repealed, and in lieu of which other Duties are by this Act impofed, conftituted, and made Part of the additional Duties granted by the faid A&t of the Forty-fifth Year of the Reign of His prefent Majefty, and it is therefore expedient that Provifion fhould be made for afcertaining the Produce of One-third Part of the Duties by this Act imposed;'

Be it therefore enacted, That from and after the faid First Day of In what Manner Augufl, One thoufand eight hundred and nine, the Whole of the Duties the Account of granted by this Act fhall be entered together in One Account; but the Duties fhall that the Lord High Treafurer for the Time being, or Lords Commif- be kept. fioners of His Majefty's Treafury, or any Three or more of them for the Time being fhall, for and during the Remainder of the faid Period of Ten Years, to be computed from the Commencement of the faid A& paffed in the Forty-fifth Year of the Reign of His prefent Majelty, caufe a feparate and diftinct Account of One-third Part of the Duties by this Act granted to be made out in fuch Manner and

Form as fhall appear to the Lord High Treasurer for the Time being, or the Lords Commiffioners of His Majefty's Treasury, or any Three or more of them for the Time being, beft adapted to afcertain the Amount of One-third Part of the faid Duties, which Account the faid Lord High Treafurer for the Time being, or the Lords Commiffiocers of His Majefty's Treasury, or any Three or more of them for the Time being, are hereby required to caufe to be laid before Parliament, together with the Publick Accounts directed to be laid before Parliament, pursuant to the Provifions of the faid Act paffed in the Forty-fecond Year of the Reign of His prefent Majefty.

XXVI. And be it further enacted, That this Act fhall commence and take Effect, as to all fuch Matters and Things therein contained, in refpect whereof no fpecial Commencement is hereby directed or provided, from and immediately after the Firtt Day of Auguft One thousand eight hundred and nine, and fhall remain and continue la force for the Space of Two Years, to be computed from that Day.

CA P. LXIV.

An Act to amend an Act paffed in the laft Seffion of Parliament, for enabling the Commiffioners for the Reduction of the National Debt to grant Life Annuities.

WHEREAS an A&t was paffed in the laft S flion of Parlia

ment, intituled, An Act for enabling the Commiffioners for the • Reduction of the National Debt to grant Life Annuities, and it was thereby provided, that the total Amount of any Annuity or Annuities to be granted upon the Continuance of the Life of any One Nominee, fhould not in any Cafe, except as therein is excepted, exceed the Annual Sum of One thousand Pounds, and that the ⚫ total Amount of any Annuity or Annuities to be granted upon the • Continuance of the Lives of any Two Nominees, or of the Life of the longer Liver of them, fhould not in any Cafe (except as aforefaid) exceed the annual Sum of One thousand five hundred Pounds: And whereas it is expedient to enable the granting of Life Annuities to a larger Amount than is limited by the faid recited A&t;' Be it therefore enacted, by the King's moft Excellent Majefly, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, That from and after the paffing of this A&t, it shall be lawful for the Commiffioners for the Reduction of Act extended to the National Debt, to grant under the Provifions of the faid recited Act any Annuity or Annuities of any Annual Amount, upon the Continuance either of the Life of any One Nominee or of the Lives of any Two Nominees, and of the Life of the longer Liver of them, fo as the fame do not in any Cafe exceed the Annual Sum of Three thoufand Pounds, except in fuch Cafes wherein by the faid recited Ac an Annuity or Annuities to a larger Amount than is thereby limited, is or are, under the Restrictions and Provifions therein contained, authorized to be granted, in which Cafes it fhall also be lawful, under the like Restrictions and Provifions, to grant any Annuity to a larger Amount than by this Act is provided, any Thing in the faid recited A&t to the contrary thereof notwithstanding.

And whereas for enabling the Receipt of Half-yearly Payments of Life Annuities granted under the Provifions of the faid • recited A&t, certain Certificates and Affidavits are thereby required to be produced to the Officer appointed in purfuance thereof, in Proof that the respective Nominees of fuch Annuities are living at the Tine of the refpective Half-yearly Payments thereof becoming due, and • fuch Officer is thereupon required, upon the Production of such Cer. ⚫tificates and Affidavi's to grant a Certificate in the Form in the Schedule to the faid Act annexed, marked (F.) for authorizing fuch Half-yearly Payments at the Bank of England: And whereas it is expe'ient to difpenfe with the Production of the faid Certificates and Affidavits in Cafes where the refpective Nominee fhall appear perfonally before the faid Officer, and fuch Officer shall be satisfied of the Identity of fuch Nominees ;' Be it therefore further enacted, That in cafe any Nominee on whofe Life any Annuity fhall depend, Instead of the whether fingly or jointly with any other Nominee, fhall appear per- Certificates, &c. fonally before the Officer appointed in purfuance of the faid recited required by A&t, on the Day on which a Half-yearly Payment of the faid An- 48 G. 3. c. 142. nuity fhall become due, or on any Day fubfequent thereto, it fhall be 16-18. for lawful for the faid Officer, in cafe he fhail be fatisfied of the Identity Annuities, the Payment of of fuch Nominee to grant a Certificate in the Form fpecified in the Certificate in the Schedule to this A&t annexed, although the Certificates and Affi- Schedule fhall davits required by the faid A&t fhall not be produced to him, which be used, where Certificate to be granted by the faid Officer in purfuance of this Act, the Nominees being produced to and lodged with the Governor and Company of the appear. Bank of England, fhall be fufficient to authorize them, and they are hereby required to pay to the Perfon entitled to receive the faid Annuity, not only the Half-yearly Payment thereof which fhall have become due on the Day on which any fuch Nominee fhall be certified as living, but also all preceding Half-yearly Payments of fuch Annuity which fhall have become due, but which fhall not have been paid, any Thing in the faid recited At to the contrary notwithstanding.

III. And be it further enacted, That if any Perfon or Perfons fhall Perfonating wilfully, falfely, and deceitfully, perfonate any true and real Nominee Nominees or or Nominees, or fhall wilfully, falfely, and deceitfully reprefent any forging Certifi other Perfon or Perfons than the true and real Nominee or Nominees cates, Felony. to be fuch true or real Nominee or Nominees, or fhall forge, counterfeit, or alter, or act, or affift in forging, counterfeiting, or altering any Certificate or Certificates to be granted by the faid Officer in purfuance of this Act, or fhall utter any fuch forged Certificate knowing the fame to be forged, counterfeited, or altered, with Intent to defraud His Majefty, His Heirs and Succeffors, or any other Person or Perfons whomfoever, then and in every fuch Cafe all and every such Perfon or Perfons fo offending, and being thereof lawfully convicted, fhall be adjudged guilty of Felony, and hall fuffer Death as in Cafes of Felony, without Benefit of Clergy.

SCHEDULE to which this Act refers. An Act for giving Jurifdiction to Juflices of the Peace to
hear and determine Profecutions for Penalties incurred by
any Offence against the Laws relating to the Revenue of
Customs; and alfo requiring all Goods, cuftomable and not.
excifeable, feized by any Police or Peace Officer to be
brought to the Custom-Houfe Warehouse in Londen, within
a certain Period.

Doubts have arisen as to the Jurifdiction of His

Majetty's Juftices of the Peace in Cafes of Profecution for • Penalties incurred by certain Offences against the Laws relating to His Majefty's Revenue of Customs: And whereas it is expcdient that the faid Juftices fhould have Jurifdiction in fuch Cafes; Be it therefore enacted by the King's mott Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the paffing of this Act it fhall and may be lawful for any Two or more of His Majefty's Juftices of the Peace for any County, Riding, Divifion, City, or Liberty wherein the Offence fhall arise, or wherein the Offender or Offenders fhall be found, to examine into, hear, and determine all Profecutions for Penalties incurred by any Offence against this or any Act or A&ts now in force, or hereafter to be made relating to His Majefty's faid Revenue of Customs; and the faid Juftices are hereby authorized and required, upon Information exhibited before them for the Recovery of any fuch Penalty or Penalties, to fummon the Party accused, and upon his, her, or their Appearance or Default, to proceed to the Examination of the Matter of Fact, and upon due Proof thereof, either upon the voluntary Confeffion of fuch Party, or upon the Oath of One or more credible Witnefs or Witneffes (which Oath the faid Juftices are hereby empowered to adminifter) to convict the Offender or Offenders in the faid Penalty or Penalties, and in cafe of the Nonpayment thereof the faid Juftices are hereby authorized and required to cause the fame by Warrant of Diftrefs and Sale under their Hands and Seals, to be levied upon the Goods and Chattels of the faid Offender or Offenders, and in Default of fufficient Diftrefs, to commit the said Offender or Offenders to any of His Majefty's Gaols in the County wherein the Offence fhall have arifen, or wherein the Offender or Offenders fhall have been found, there to remain for the Space of Six Months, or until the faid Penalty or Penalties fhall be paid.
