An Act to permit the Trade between Great Britain and the United States of America to be carried on in Ships or Veffels belonging to the Inhabitants of the faid States.

[3d June 1809.] THEREAS it is expedient to permit the Importation, intol Great Britain, of Goods, Wares, and Merchandize of the Growth, Production, and Manufacture of the United States of • America, directly from thence in Ships or Veffels belonging to the Subjects of thofe States;' Be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That it fhall be American Goods lawful for Perfon or Perfons to import into Great Britain directly may be imported any from any of the Territories of the United States of America, any Goods, Wares, or Merchandize, being of the Growth, Produce, and Britain in Manufacture of any of the faid United States, which are not prohibited Veffels, on like by Law to be imported from Foreign Counties, in Ships or Veffels Duties as if built in the Countries belonging to the United States of America, or imported in any of them, or in Ships or Veffels taken by any of the Ships or Veffels Ships not of War belonging to the Government or any of the Inhabitants of British-built. the faid United States having Commiffions or Letters of Marque and Reprifal from the Government of the faid United States, and condemned as lawful Prize in any Court of Admiralty of the faid United States, of which Condemnation Proof fhall be given to the Commiffioners of His Majefty's Customs, or any Four or more of them, in England or Scotland refpectively, and owned by the Subjects of the faid United States, if any of them, and whereof the Mafter and Taree-fourths of the Mariners at leaft are Subjects of the faid United States; and to enter and land fuch Goods, Wares, and Merchandize, on Payment of fuch Duties as are or may be payable on Articles of the like Defcription when imported into Great Britain in Ships or Veffels not being British-built; any Thing contained in an A&t paffed in the Twelfth Year of His Majefty King Charles the Second, intituled, An At for the encouraging and increafing of Shipping and 12 Car. 2. c. 18, Navigation, or in any other A&t or Acts of Parliament to the contrary notwithstanding.

An Act for allowing the Importation from any Port in Europe or Africa, of Goods or Commodities the Growth or Produce of any Country, until Six Months after the Ratification of a Definitive Treaty of Peace. enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the paffing of this Act, during the Continuance of Hoftilities, and until Six Months after the Ratification of a Definitive Treaty of Peace, it fhall and may be lawful, under any Order of Council. already iffued or to be iffued, to import into the United Kingdom from any Part of Europe or Africa in any British Ship or Veffel, or in any Ship or Veffel belonging to any Country in Amity with His Majefty, in any Manner navigated, any Goods or Commodities which may be lawfully imported, being the Growth or Produce of any Country, upon Payment of the fame Duties, and fubject to the fame Rules, Regulations, and Reftrictions, Penalties, and Forfeitures, as the fame would be fubject to if imported directly from the Place of the Growth or Produce of fuch Goods or Commodi ties refpectively, in the fame Ships or Veffels refpectively.

II. And be it further enacted, That every Importation of Goods or Commodities from any Part of Europe or Africa, under any Order of Council which has already iffued, and which would have been warranted by this Act, fhall be deemed and taken to be good in Law, in the fame Manner as if fuch Order had been iffued in pursuance of this Act, any Act or Acts now in force to the contrary notwithftanding.

An Act for making Sugar and Coffee of Martinique and Marie-
galante liable to Duty on Importation as Sugar and Coffee
not of the British Plantations.
[3d June 1809.].
HEREAS the Islands of Martinique and Mariegalante in the
Weft Indies have been furrendered to His Majefty's Arms, and
are now in His Majefty's Poffeffion; in confequence whereof the
Trade of the faid Islands is now by Law to be carried on in the fame
Manner as the Trade of the other British Colonies and Plantations
in the West Indies: And whereas it is expedient at prefent that
Sugar and Coffee, the Growth, Production, or Manufacture of the
faid Islands, fhould not be permitted to be imported into this
Kingdom upon the fame Terms as Sugar and Coffee of the Britif
Plantations; Be it therefore enacted by the King's moft Excellent
Majefty, by and with the Advice and Confent of the Lords Spiritua!
and Temporal, and Commons, in this prefent Parliament affembled,
and by the Authority of the fame, That Sugar and Coffee, the
Growth, Production, or Manufacture of the Illands of Martinique
and Mariegalante, imported into this Kingdom, fhall be fubject to
the Payment of fuch Duties, and alfo to fuch Rules, Regulations, and
Rettrictions, Penalties, and Forfeitures as are by Law impofed and pro-
vided, in the Cafe of Importations of Sugar and Coffee not of the
British Plantations; any Law, Cuftom, or Ufage to the contrary not-
withstanding.

An Act to amend feveral Acts for the Prevention of Smuggling; for better fecuring the Duties on Coals, Culm, and Cinders; and for permitting the Exportation of Salt, Pepper, and Wine, from Guernsey or Jersey to Sark, in fmall Packages. [3d June 1809.]

WHEREAS the Officers of the Cuftoms and Excife, and

Every Perfon, (not a l'affenger) on board British Veffels required to be licensed by the Admiralty, found within the

Limits herein mentioned, from which any Part of the Cargo

other Perfons authorized to make Seizures, are frequently • prevented from feizing Goods fubject to Forfeiture, with which Ships, Veffels, and Boats may have been laden, by reafon of the ⚫ fame having been thrown overboard during the Chace; and if fuch Ships are found light, or the Goods are not afterwards difcovered and feized, the Perfons on board are not liable to be arrested and detained under the Authority of an Act paffed in the Forty-fifth Year of His prefent Majefty, intituled, An Ad for the more effectual 45 G. 3. c. 191 • Prevention of Smuggling: And whereas it is expedient in certain Cafes to make Provifion for the Arreft and Detention of Perfons on board fuch Ships, Veffels, and Boats, and for rewarding the Officers by whom fuch P-rsons are so arrested and detained;' Be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lordз Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, That whenever any Ship, Veffel, or Boat, belonging in the Whole or in Part to His Majefty's Subjects, for which the Owner or Owners thereof are required to have a Licence for navigating the fame from the Lord High Admiral of Great Britain, or the Com. miflioners of the Admiralty for the Time being, or other Perfons duly authorized to grant the fame, fhall be found or difcovered to have been within Four or Eight Leagues of fuch Part of the Coafts of Great Britain or Ireland refpectively, as are in any Act or A&ts of Parliament in force on and immediately before the paffing of this A&t defcribed and fpecified as to fuch refpective Distances of Four or Eight Leagues, or found in any Part of the British or Irish Channels, or elsewhere on the High Seas, within One hundred Leagues of any Part of the Coafts of Great Britain or Ireland, and any Perfon or Perfons on board fuch Ship, Veffel, or Boat, fhall, at any Time during the Chace, or previous to fuch Ship, Veffel, or Boat being taken Poffeffion of, within any or either of fuch Limits or Distance aforesaid, unfhip, or throw overboard the Cargo, or any Part of the Cargo, unlefs through any unavoidable Neceffity or Diftrefs, or for the Security or Prefervation of the Ship, Veffel, or Boat from the Dangers of the Seas, fuch Ship, Veffel, or Boat being then laden with a legal Cargo, every Perfon or Perfons found on board being a Subject or Subjects of His Majefty, and who shall not prove that he was only a Paffenger on board fuch Ship, Veflei, er Boat, fhall forfeit the Sum of One hundred Pounds, to be recovered as any like Penalty may be recovered under any Act or Acts relating to the Revenue of Cuftoms or Excife in the United Kingdom; and it fhall be lawful for the Officer or And may be dealt Officers of the Army, Navy, or Marines, or of the Cuftoms or Excife, by whom fuch Ship, Veffel, or Boat fhall be feized, and he and they is and are hereby authorized, empowered, and required to ftop, arreft, and detain every fuch Perfon being a Subject of His Majefty, and fuch Perfon fhall be dealt with as any Perfon is liable 49 Geo. to be dealt with by virtue and in purfuance of the faid recited A& paffed in the Forty-fifth Year of His Majefty's Reign, for having been taken on board any Ship, Veffel, or Boat liable to Forfeiture by that or any other At or Ats of Parliament, for being found or having been at Anchor, or hovering within any fuch Distance of any of the Dominions of His Majefty, with fuch Goods on board as fubject fuch Ship, Veffel, or Boat, or Goods to Forfeiture; or every fuch Perfon, being a Seaman or Seafaring Man, may be dealt with as any Seaman or Seafaring Man may be dealt with by virtue and in purfuance of an A& paffed in the Forty-leventh Year of His prefent Majefty's Reign, intituled, An Ad to make more effectual Provifion for the Prevention of Smuggling; and every Officer of the Army, Navy, or Marines, or of the Cuftoms or Excife, fhall have the like Powers and Authorities, and be entitled to and receive the like Reward or Rewards for and on account of every Perfon arrested and detained under the Authority of this Act, as is and are allowed and payable with refpect to any Perfon arrested and detained under the Authority of either of the faid recited Acts, as fully and effe&tually to all Intents, Conftructions, and Purposes, as if each and every of the Clauses, Directions, Powers, and Authorities relative thereto were repeated and re-enacted in the Body of this prefent A&t.

II. And Whereas by an A& paffed in the Forty-feventh Year of His prefent Majefty's Reign. intituled, An Act to make more effectual Provifion for the Prevention of Smuggling, it is amongtt other Things provided in the Cafe of Seizures of Spirits, Tobacco, or Snuff made at Sea, or in any Port or Harbour, that if any Officer of the Culoms or Excife, or other Perfons making fuch Seizure, fhall neither feize ⚫ and profecute, nor caufe to be feized and profecuted the Ship, Veffel, or Boat, in or on board which fuch Spirits, Tobacco, or Snuff ⚫ fhall be or fhall have been brought, found, or feized, or which fhall be used or employed in removing or conveying the fame, nor fhall ftep, arreft, and detain the Perfons, or fome or one of them, who fhall be or shall have been employed in navigating the Ship, Veffel, ⚫or Boat, in or on board which fuch Spirits, Tobacco, or Snuff shail be or shall have been brought, found, or feized, or in unlading, removing, or carrying fuch Spirits, Tobacco, or Snuff, nor fhall not convey or cause every fuch Perfon fo arrelted or detained to be taken or conveyed before One or more of His Majefty's Juftices of the Peace to be dealt with according to Law, then and in every fuch Cafe the Officer of the Cuftoms or Excife, or other Perfons making fuch Seizure, fhall be entitled to and fhail be paid only One-Fourth Part of the Value at which fuch Spirits, Tobacco, or Snuff fhail he or fhall have been refpectively eftimated or fixed according to the Directions of the faid A&t: And whereas the pernicious Practice of Smuggling by Means of tinking fmall Cafks of Spirits at Sea, and within the Limits of the Ports of this Kingdom, and getting them up as Opportunity offers, appears to have been much reforted to, and it is therefore expedient to extend and increase the Rewards to • Officers of the Cuftoms and Excife, and other Perfons legally authorized to make Seizures, by whofe Exertion and Diligence fuch Practice may be counteracted; Be it therefore enacted, That in all Cafes where any fuch Officers and Perfons as aforefaid fhall feize, within the Limits of any of the Ports of this Kingdom, or in any of the British or Irish Channels, or elsewhere on the High Seas, within

One hundred Leagues of any Part of the Coafts of Great Britain or Ireland. any Spirits which fhall have been funk or concealed under or in the Water within fuch Limits or Distance, every fuch Officer and Perfon to feizing fuch Spirits fhall be, and he and they is and are hereby allowed One Moiety of the Value at which fuch Spirits fhall be fixed or estimated as aforefaid; anv Thing contained in the faid recited A&t, or in any other A&t or Acts of Parliament to the contrary thereof in any wife notwithstanding.

III. And Whereas by the faid A&t made in the Forty-fifth Year 45 G. 3. c. 121, of the Reign of His prefent Majefty, it was enacted, that every § 7. • Perfon being a Subject of His Majelty who fhould be found or ⚫ taken on board, or discovered to have been on board any Ship, Veffel, or Boat liable to Forfeiture as therein mentioned, and who fhould not prove that he was only a Paffenger on board fuch Ship, • Veffel, or Boat, and every Perfon found aiding or affifting in unfhip ping to be laid on Land, or found carrying, conveying, concealing, or affifting in the carrying away, conveying, or concealing any Fo reign Brandy, Rum, Geneva, or Spirits, in that A&t mentioned, fhould forfeit for every such Offence either Treble the Value of the Goods that should be found or taken from fuch Person or Perfons, or the Sum of One hundred Pounds, at the Option and fubject to the Election therein mentioned; and that it fhould be lawful for any Officer or Officers of the Army, Navy, Marines, Customs, or Excife, and he and they was and were thereby authorized, empowered, and required to ftop, arreft, and detain every fuch Perfon being a Subject of His Majefty, and to convey the said Perfon before One or more of His Majesty's Justices of the Peace refiding near to the Port or Place into which fuch Ship, Veffel, or Boat fhould be taken or carried, or near to the Place where any fuch Perfon fhould be fo taken or arrested, and it should be lawful for fuch Juftice or Juftices of the Peace, and he and they was and were thereby required upon Proof on Oath by One or more credible Witnefs or Witnesses, that fuch Perfon was fo found or taken, or discovered as aforefaid, • unless any fuch Perfon found or taken or having been on board of any fuch Ship, Veffel, or Boat, fhould prove to the Satisfaction of fuch Juftice that he was only a Paffenger on board fuch Ship, Veffel, or Boat, to hold fuch Perfon to bail with Two good and fufficient Sureties in the Sum of One hundred Pounds each for the Appearance of fuch Person to answer to any Indictment or In⚫ formation that might be brought against him in that Behalf, and to pay fuch Penalty and abide any Judgment for any fuch Offence, and in default of any fuch Perfon finding fuch good and fufficient Bail as aforefaid, or until the fame should be found, to commit fuch Perfon to any Gaol or Prifon or Honfe of Correction to answer as ⚫ aforefaid; and it is by the said A& provided, that if any fuch Perfon fo found or difcovered and taken as aforefaid, fhould be capable ⚫ and defirous of entering and ferving as a Seaman or Marine in any of His Majefty's Ships of War, it fhould be lawful for the Officer or Officers of the Army, Navy, or Marines, or of the Cuftoms or Excise by whom fuch Perfon was taken, arrefted, and detained as aforefaid, or for any fuftice of the Peace or Magiftrate before whom any fuch Perfon might be carried, and fuck Officer or Officers was and were thereby authorized, empowered, and required inttead of taking fuch Perfon before any Justice or Magiftrate, and fuch • Juftice
