Parliament for continuing to His Majefty certain Duties on Malt, Sugar, Tobacco, and Snuff, in Great Britain, and ont Penfions, Offices, and Perfonal Eftates in England, for the Service of the Year One thoufand eight hundred and nine, alfo the faid Act made in the Thirty-eighth Year of His prefent Majefty; and for indemnifying fuch Perfons as have acted as Commiffioners for executing the faid Acts.

HEREAS it is expedient to rectify Mitakes made in the
naming or deferibing of Perfons appointed Commiffioners by

an A&t made in the laft Seffion of Parliament, intituled, An At 48 G. 3. c. 102. for appointing Commiffioners for carrying into Execution an Act of this

Seffion of Parliament for granting to His Majefly a Duty on Penfions

and Offices in England, and an A& made in the Thirty-eighth Year [38 G. 3. c. 5.]

of His prefent Majefty for granting an Aid to His Majelly, by a Land Tax, to be raised in Great Britain for the Service of the Year One thousand feven hundred and ninety eight, and there may be Occafion to 'appoint other P rfons to put in Execution the faid A&t made in the Thirty-eighth Year of the Reign of His prefent Majelly, for granting an Aid to His Majefty by a Land Tax, to be raifed in Great • Britain for the Service of the Year One thoufand feven hundred and ninety-eight, and alfo an A&t of this Seffion of Parliament, 'intituled, An Ad for continuing to His Majely certain Duties on Malt, 49 G. 3. c. 1. • Sugar, Tobacco and Snuff, in Great Britain, and on Penfions, Offices, and Perfonal Eftates, in England, for the Service of the Year One thou fand eight hundred and nine; may it therefore please Your Majefty, that it may be enacted,' and be it enacted by the King's most excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, That the feveral and Commiffioners refpective Perfons herein-after named, fhall and may and are hereby appointed. empowered and authorized to put in Execution the said Acte, and all the Claufes, Powers, Matters, and Things whatsoever therein con. tained, as Commiffioners in and for the feveral and refpective Counties and Places of Great Britain, herein after feverally and refpectively mentioned and expreffed, as if they had been named with the other Commiffioners in the faid A&t of the laft Seffion of Parliament, and properly defcribed therein; (that is to fay.)

[Then follows the Lift of Names for the feveral Places.] And no Mistake in the Spelling of the Chriftian or Surname of any Perfon, or of any Place, mentioned in the faid A&t of the laft Seffion of Parliament, or this Act, fhall be conftrued to vitiate the Appointment of fuch Perfon to be a Commiffioner, fo that the Perfon or Pace mentioned be designated therein to common Intent and Underftanding; or to fubject any Perfon fo defignated to any Pains, Penalty, or Forfeiture, for his acting in the Execution of the Acts herein mentioned.

"Perfons appointed by recited A&t or this A&t fhall have the Qualifications required by 38 G. 3. c. 5. and 38 G. 3. c. 48.5 2. Qualified Perfons in Cities, &c. rated to the Duty on Penfions, "&c. may act as Commiflioners. § 3. Perfons not properly named, "or whofe Names have been omitted, who may have acted as Com. miffioners,

CA P. LVI.

An Act for completing the Militia of Ireland. [3d June 1809.] "Recital of 49 G. 3. c. 5. Number equal to Two-fifths of the

Etablishment of the Militia in Ireland, shall be raised within Twelve "Months. Etablishment of augmented Regiments fhall remain as "under 44 G. 3. c. 33. and of the others as under General Militia A&t; "all above fhail be confidered as Supernumeraries. § 1. Men fhall "be raised by volunteering. Lord Lieutenant fhall give Directions to "the Colonels and the Treafury as under 44 G. 3. c. 33. and all the "Powers of that Act fhall be applied in Execution of this Act. "Bounty fhall not exceed S1. 85. Oaths of Volunteers fo raised shall "be the fame as that of Subfitutes. § 2. Further Sum of One Guinea 46 per Man may be advanced to the Colonel for Expences of procuring "Men; but no Part thereof shall be paid to the Volunteers. §3, 4. "Men may be required by Lord Lieutenant to be railed by Ballot, "and in fuch Cale they fhall be raised as under exilling Acts relating "to Irish Militia. § 5. General Meetings of the Governors, &c. in "each County, within Ten Days after Lord Lieutenant's Order, fhall "appoint the Number of Men for each Subdivision, &c. § 6. Bounty to ballotted Men and Subftitutes fhall be paid under Regulations "of Lord Lieutenant. §7. Colonels fhall fend Monthly to Lord "Lieutenant's Chief Secretary, and to Clerk of Annual Meetings, "Lifts of Men enrolled. § S. Fine of 30l. on Counties for every "Man deficient at the End of Twelve Months after palling this A&'; on Certificate of D ficiency by Colonels to Treafurers of Counties, "which shall be laid before the Judges of Affize; and the Fine levied "by the Treasurer's Order of the Court. §9. All former Acts hall remain in force, except as exprefsly altered by this A&t. § 11. After Auguß 1, 1810, "Two further Periods may be appointed for enlifting of Militia Men into the Regulars. § 12. (See 49 G. 3. c. 5. §3.) Act may be repealed or altered this Seffion. § 13.

An Act for improving the Quality of Beer in Ireland, by fur-
ther preventing the Ufe of unmalted Corn, or of any dele
terious or unwhole fome Ingredients therein, and for the
better fecuring the Collection of the Malt Duties in Ireland.

WHEREAS by an Act made in the Forty-fifth Year of His
prefent Majetty's Reign, intituled, An Ad for the Collection
of the Malt Duties in Ireland and regulating the Trade of a Malijter,
it is amongst other Things enacted, That in every Cale where the
• Stock of Malt in the Poffeffion of any Maltfter, or of any Factor or
• Dealer in Malt, or of any Brewer or Diftiller, fhall be lefs than the

exceeds 1 Bufhel

of Excife ought to be in the Poffeffion of fuch Maltfter, Factor, • Dealer, Brewer, or Diftiller, every fuch Perfon fhall for every such Time fuch Decrease fhall appear, forfeit the Sum of Fifteen Shillings for every Barrel of Malt which fhall fo appear to be deficient ;' Be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That every fuch Perfon fhall, for every Time fuch De- Penalty on crease fhall appear, forfeit the Sum of Thirty Shillings for every undue Decreafe Barrel of Malt which fhall fo appear to be deficient, inftead of the of Malt 30s. per faid Sum of Fifteen Shillings in the faid As mentioned: Provided Bufhel: if it always, that whereas by reafon of the Quantity of Malt being taken account of by the Officer according to the Gauge, and being fold or ufed or confumed by fuch Maltter, Factor, Dealer, Brewer or Diftiller, in Bushels or Barrels, according to the Weight thereof, Deficiencies may arife between fuch Stock Account and the actual Quantity of Malt in Store, no Maltfter, Factor, Dealer, Brewer, or Diftiler, fhall be liable to fuch Penalty of Thirty Shillings per Barrel in any Cafe where fuch Decrease fhall not exceed the Proportion of one Barrel of Malt for every Twenty Barrels of the whole Quantity in which fuch Decreafe fhail appear, unless in Cafes where Fraud or Intention of Fraud fhail appear; any Thing in the faid recited A&t or this Act to the contrary notwithstanding.

II. And be it further enacted, That fo much of an A&t made in the 48 G. 3. c. 79. Forty-eighth Year of His prefent Majefty's Reign, intituled, An A § 5. repealed in to amend the Two Ads for the collecting of the Malt Duties in Ireland, part. and regulating the Trade of a Maltfler, as epacts that no Place which fhall have a Communication by internal Doors with, or fhall be adjoining to that Part of any Distillery or Brewery where any Keeve or other Veffel for mashing fhall be kept, fhall be registered as a Store for keeping of Malt, fhall be and the fame is hereby repealed; and that No Math Keeve from and after the Day of paffing this A&t, no Mash Keeve, nor shall be registered any Part or Place of any Diftillery or Brewery where any M. fh Keeve as a Malt Store. fhall be kept, fhall be entered or registered as a Store for keeping of Malt by any Brewer or Diftiler in Ireland.

Hours.

III. And be it further enacted, That from and after the Expiration Penalty on of Ten Days after the Day of paffing of this Act, if any Worts which Words not being fhall have been drawn off from the M fh Keeve more than Twenty- hopped in 24 four Hours, fhall be found in the Poffeffion of any Brewer, or in the Forfeiture and licenfed Brewery of fuch Brewer, or in the Stores there to belonging, 100!. not mixed with or in which there fhall not be infufed Hops in Quantity fufficient to make the fame into Beer, Alt, or Porter, ali uch Worts fhall be forfeited and may be feized, and fuch Brewer fhail forfeit the Sum of One hundred Pounds.

IV. And be it further enacted, That from and after the Expiration of Ten Days after the Day of paffing of this Act, no Brewer or Brewers, or Perfon or Perfons licensed to brew Strong Beer. Porter, Ale, or Small Beer for Sale, fhall give, fell, or in any Manner difpofe of any Worts, or Pot Ale, to any Perfon or Perfons whatfoever; and in cafe any fuch Brewer or Brewers, or Perfon or Perfons fo licenfed, fhail at any Time give, fell, or in any Manner difpofe of any Worts, or Pot Ale, to ary Perion or Perfons whatsoever, fuch Brewer or Brewers, or Perfon or Perfons fo giving, felling, or in any Manner difpofing of the fame, fhall forfeit the Sum of Five hundred

A.D. 1809. Pounds; and any Licence granted to fuch Brewer or Perfon fhall thereupon be and become ipfo fa&o void, and fuch Brewer fhall be confidered as unlicenfed, and liable to all fuch Penalties and Forfeitures as Perfons brewing Strong Beer, Porter, Ale, or Small Beer for Sale, without having a Licenfe for that Purpose in force, fhall be liable to by any A&t or A&ts in force in Ireland for that Purpose.

V. And be it further enacted, That from and after the Expiration of Ten Days after the Day of paffing of this Act, no Mait shall at any Time be removed from or out of the Stores, or other Room or Place of any Brewer or Perfon licenfed to brew Strong Beer, Porter, Ale, or Small Beer for Sale, or fhall be brought or conveyed into the Mill, Brewery, or Mafh Keeve, of fuch Brewer or Perfon without a Permit for the fame; and that the Brewer or Perfon applying for fuch Permit, fhall in his or their Request Note for obtaining the fame, ftate the Day and Hour of the Day on which fuch Brewer or Perfon intends to begin to mafh or brew the Malt fo to be removed; and in cafe any Quantity of Malt, ground or unground, whether in any Procefs of brewing or not, fhall be found in the Mill, Brewery, or Mafh Keeve of fuch Brewer or Perfon fo licenfed, and a Permit for removing the fame into fuch Mill, Brewery, or Mash Keeve, fhall not on Demand of any Officer of Excife be produced, or Proof made to fuch Officer that fuch Permit had been granted for fuch Malt, and that fuch Permit was afterwards loft or mislaid, or if any fuch Malt fhall be found in Procefs of brewing or mathing, or wetting before the Time specified in the Requeft Note for fuch Permit, in either of fuch Cafes all fuch Malt fhall be forfeited and may be teized, and fuch Brewer or Perfon fhall forfeit the Sum of Forty Pounds, and every fuch Permit fhall from Time to Time be delivered by fuch Brewer or Perfon, or his Servant, to the Surveyor or other Officer of Excife in Charge of the Malt Stores of fuch Brewer or Perfon, within Twelve Hours after the Expiration of the Time for which fuch Permit fhall be in force, or at ary Time within fuch Twelve Hours, on Demand thereof made by fuch Officer; and if fuch Permit fhall not be delivered to fuch Officer accordingly, fuch Brewer or Perfon fhall torfeit for every Neglect Twenty Pounds.

VI. And be it further enacted, That whenever it fhall happen that the Licenfe of any Perfon licenfed to brew Strong Beer, Porter, Ale, or Small Beer for Sale, fhall become forfeited or void by reason of any Offence against this A&t, or any Act or Acts of Parliament regranted without lating to fuch Brewers, or to the brewing or making of Strong Beer, Porter, Ale, or Small Beer for Sale, no future License shell be granted to fuch Perfon, nor to any other Perfon to brew in the fame Brewery, unless fuch Perfon fo to be licensed fhall have firft entered' into a Bond to His Majefty, His Heirs and Succeffors, in the Penalty of One thousand Pounds, (that is to fay), the Perfon licensed in Five hundred Pounds, and Two Sureties in Two hundred and fifty Pounds each, fuch Sureties to be approved of by the Commiffiouers of Inland Excife and Taxes in Ireland, or by fome Perfon to be by them authorized in that Behalf, and fuch Bond to be conditioned that fuch Perfon fo licensed fhall in all Things well and truly conform to and obey the Laws in force in Ireland relating to Perfons licensed to brew Strong Beer, Ale, or Porter for Sale, and shall not in any Particular tranfgrefs any A&t or Acts of Parliament with refpect to Perfons fo licenfed, or with refpect to the brewing or making of Strong Beer,

Porter, Ale, or Small Beer for Sale, or any Claufe, Matter, or Thing whatever in any fuch Act or Acts of Parliament, which are or shall be in force at the Time of the granting or during the Continuance of any fuch License; and in cafe it fhall happen, that any Perfons fo licenfed fhall a fecond Time offend, and fuch Licence fhall be a fecond Time forfeited, fuch Perfon fhall be incapable of receiving a Licence for the Space of Three Years from the Twenty-ninth Day of September next enfuing the Time of the Forfeiture of fuch Licence, and no Licence fhall after fuch fecond Offence be granted to any Perfon whatever to brew in the Brewery of the Party so offending, until the Expiration of Three Years from the Twenty-ninth Day of September next enfuing fuch fecond Forfeiture of fuch Licence, nor unless the Perfon licensed to brew in fuch Brewery fhall enter into a Bond in the Penalty of Two thoufand Pounds, (that is to fay), the Perfon licensed in One thousand Pounds, and Two Sureties in Five hundred Pounds each, to be approved of, and fuch Bond to be conditioned as immediately herein before directed.

VII. And be it further enacted, That in cafe the Commiffioners of Inland Excife and Taxes in Ireland, on Application made to them for that Purpose by any Brewer, and on Affidavit made by fuch Brewer of the Circumstances under which he shall be defirous to fell any Malt which he is not authorized by Law to fell, fhall think it fitting and expedient that fuch Brewer fhould be allowed to fell fuch Malc, it fhall and may be lawful for the faid Commiffioners, or any Three or more of them, by an Order under their Hands, to direct that a Permit fhall be granted for the Removal of fuch Malt; and fuch Permit fhall be granted, and fuch Malt fhall and may be removed accordingly, any Thing in any Act or Acts to the contrary notwithftanding; and fuch Brewer fhall not be liable to any Penalty, nor fhall fuch Malt be liable to Seizure or Forfeiture on account of fuch Sale. VIII. And, to prevent Brewers from ufing Brewing Coppers or For registering Coppers in their Cooperages as Stills, be it enacted, That from and Coppers, Math after the Expiration of Ten Days after the Day of paffing this Act, no Licence fhall be given or granted to any Perfon to brew Strong Beer, Porter, Ale, or Small Beer for Sale, unlefs the Party applying for fuch Licence fhall have previously entered and registered in the Excife Office of the District, every Brewing Copper and every other Copper of any Sort whatever which fuch Perfon fhall have in his Brewery or Premifes, whether for brewing or for fcalding or steaming Cafks or otherwife, and alfo every Mah Tun and Keeve in any fuch Brewery or Premifes, defcribing in the faid Entry or Register the Contents of all and every fuch Copper or Coppers, and alfo defcribing for what Purpose they are or fhall be ufed, and whether the fame or any of them are Steam-tight or not, and in like Manner defcribing the Contents and Dimenfions of every fuch Mash Tun or Keeve; and in cafe any Perfon fo licenfed fhall at any Time during the Continuance of fuch Licence, make any Alteration in any Copper, Math Tun, or Keeve fo registered, or fhall erect or fet up any new Copper, Mash Tun, or Keeve, fuch Perfon fhali make a like Entry and Registry of fuch Alteration, or of fuch Copper, Mash Tun, or Keeve to newly erted, in the faid Excife Office; and in cafe any Perfon fo dicenfed fhall ufe or have in his or her Brewery or Premifes, any Copper or Coppers, or Mash Tun or Keeve not fo entered and registered, or other than fuch as fhall be entered and registered as aforelaid, every
